In my experience the father claims the Familienzulagen, it is paid by the Familienausgleichskasse with his monthly salary. He would need the childrens' birth certificates showing he is the father. He should take these together with his work contract to his company's Personalabteilung for forwarding the Photocopies to the Arbeitgebendenausgleichskassen.

If he is not going to claim the money, then you have to get a certificate from his company's Familienausgleichskassen, stating that they are not paying out the Familienzulagen.
