Firstly it is not relevant to EU/EFTA citizens as they are covered much earlier in the reference to the bilateral agreement.
So this only applies to non-EU citizens.
Art. 37 states quite clearly that you need to request the permission in advance of the receiving canton.
Art. 37 also states that ONLY those with a B permit have a right to a canton change and then ONLY if they are employed. The other condition attached is additionally reason to throw someone out so that is hardly relevant.
This is an improvement but it is not free movement of foreigners between cantons...
