I have noticed that it depends on where my starting point is as to whether I have to "untick" the insurance box or not : Geneva I have to, England I don't. Hadn't thought about why before, but I expect that the law you quote only applies to UK and not here.
Apart from that, I have no problem paying extra for when I have luggage. If I'm travelling with only hand luggage, why should I pay the same as someone who needs their suitcase put on the plane ? At least (as far as I know) Easyjet are not considering making you pay for use of toilets like Ryan air have suggested
