proof of postage is not the same as proof of delivery. when you send enough stuff you realise all sorts of weird things can happen.

parcels get delivered to the wrong place, or lost. in some cases where i refunded, the buyer wrote back 2 weeks later to say that they received it after it was delivered to a similar address around the block.

another parcel got lost in the system for 2 months and found its way back to me. another time, same thing, disappeared for a month but ended up at the customer.

just in my apartment block, a neighbour put up a notice that 3 parcels had been stolen from him.

i wouldn't automatically assume a scam.

I would like to thank all for sharing the constructive advice and comments. The item in question was a vintage band T-shirt and the total value of the transaction 86 CHF. Not a huge figure, but when I know I have done all according to the rules, it must go a very long way until I finally resign myself to swallow that. Specifically under such very clear circumstances.

Anyway, after presenting over and over to Paypal the facts, including the eBay user agreement about responsibility in private-to-private transactions, their own user agreement about buyer protection, some pointers from the Federal Consumer Affairs Bureau FCAB, they decided to refund to my account the full amount "as a one time courtesy" being myself a "a very loyal customer to us".

My next step was going to be getting to my legal insurance and get their advice. Fortunately this insanity from Paypal stopped short of that.

Now, there is a huge flaw in their regulation, whereby they ask the seller to present "valid online tracking details or a valid proof of shipping which contains the destination address of the shipment". In such case they must require the buyer to use a shipping service fulfilling such requirements. It used to be like this many years ago. A buyer could not just wake up in the morning and decide to freely claim the sale money back after skimping on the postage rate in order to save money.

What is also clear is that the seller in their view is *always* the culprit and in order to reverse that one has to perseverate until the issue gets finally escalated to a real person who *reads* (and possibly understands) what you are writing to them.

Anyway, my future use of Paypal is in question. Surely if I do, I will need to scrap from the offer to buyers the basic postage rate or economy sending. International buyers will be greatly penalised.

Sorry to tell you, but it is you who will be greatly penalised as people will not buy from you, your pool of potential buyers will be greatly reduced......

Which is a stupid rule anyway; it just proves you sent something. I could claim you sent me a bunch of newpaper.

I'd insist the parcel be opened in front of a magistrate or member of the (British) royal family.

Depends on value and uniqueness of item. In this case better via signed for, especially overseas.
If one was selling low end item and had duplicate, not a problem, as if buyer claimed non receipt, one could then send replacement via signed for or take the hit

Above 8 years ago in Uk had a dispute with Buyer over description of item & they won the case, but they sent rubbish in envelope by return. Paypal said we had to take to Police station and get a case number. Police said it was a civil matter. Paypal did refund us, but the whole episode was unpleasant to us.

Paypal makes their money via percentage commissions and it is mainly out to protect the buyer.
Seller beware.

PayPal couldn't give a shit about the buyer or seller they just want to make money. As a buyer the few times I've raised disputes I may as well have talked to my dog.

Hello,

I work for eBay in finance in Bern and Zurich. It is unfortunate, the ebay site is really geared as a buyer marketplace. Even feedback, you can't give a negative feedback to a buyer, only a seller. That is unfortunately the ethos, buyer over seller. Which is wrong as it is a marketplace, and this mentality is causing sellers to leave ebay.

As paypal has gone for the buyer and given refund, there is not much that can be done. Even in a small claims court, several do happen where seller are understandably disgruntled but often they again vote in favour of buyer,

Exactly... article a while ago about a seller getting sent a bar of soap so the buyer could get a tracking number.
