I'm not so sure. I think Jrspet is correct - your cc can chargeback or you can dispute the charge. Then the vendor has to prove you got your merchandise.
Also, you only mention you emailed the company. How long after you were supposed to get the merchandise did you email them? Have you tried calling too? Sending a registered letter? There are plenty of options still left for you, but it might require some time and effort on your part. Hope it works out.
