Renting from LG Immo SA

From January 1, 2012 till December 31, 2012 we rented a 3.5 bedroom apartment from LG Immo Suisse (LorisGroup Immobilier, LG Real Estate Switzerland SA), Ch. De Maillefer 33, CH-1018 Lausanne. The apartment was located at Avenue des Bergieres 55, 4th floor left in Lausanne. The purpose of this posting is to document the negative experiences that we made with LG Immo Suisse.

On January 9, 2012, which is the day we were going to fly to Switzerland from Canada, we received an email from LG Immo Suisse informing us that construction was taking place on the 4th floor of our apartment building and that we couldn't stay in our apartment due to occasional noise. Instead we were told that we had to stay in an apartment at Riant Mont 23, 1th floor during January.

When we arrived at Riant Mont 23 at the agreed time, nobody was there. We couldn't reach anyone by phone and the "technical supervisor" with whom we had scheduled the appointment showed up half an hour late. The apartment turned out to be only a 2.5 bedroom apartment, which was too small for our needs. The technical supervisor promised to bring us an additional bed. The bed turned out to be an uncomfortable sofa bed. He also mentioned that the reason for us not being able to move into Avenue des Bergieres was work on the roof. During the month of January, we went by Avenue des Bergieres 55 several times to pick up our mail. We were never able to observe any signs of construction from the outside.

Since the apartment at Riant Mont 23 was smaller than the apartment that we had signed a contract for, LG Immo Suisse promised us a discount. The discount ended up in the amount of CHF 300.00. However, according to the online advertisement for Riant Mont 23, its rent was CHF 700.00 lower than the rent listed in our rental contract for the apartment at Avenue des Bergieres 55. When we complained, we were told that the rent listed in the online advertisement applied only if the apartment was rented for at least three years. This is hard to believe for two reasons: First, the online advertisement for Riant Mont 23 (and for Avenue des Bergieres 55) did not contain such a clause. Second, for our apartment at Avenue des Bergieres 55 the rent listed in the rental contract corresponded to the rent listed in the online advertisement in spite of us renting for only one year.

At the end of January, we wanted to schedule an appointment to move into the apartment at Avenue des Bergieres 55 on February 1. We were told that we could move in only on February 2 because the "top of the building has to be cleaned because full of dust."

While moving in on February 2, we were told that everything was new in the apartment. But there were obvious signs of wear and tear in the apartment, which we dutifully reported.

The online advertisement for our apartment came with several pictures. As it turned out, only one of the pictures was actually made in our apartment. For example, one of the pictures in the advertisement showed a balcony, which our apartment did not have.

At the end of each month, we would get the rental statement for the next month. LG Immo Suisse never managed to send us a proper bill for our energy fees. At the end of May, we got an energy bill that probably was for a different apartment on our floor since it listed a credit, instead of a charge. Nonetheless, the rental statement charged us for the credited amount. Unfortunately, I failed to notice this issue and did not dispute the statement.

At the end of June, we got an energy bill listing an actual charge. However, this bill was clearly not for our apartment since it listed cable charges, but we had no cable. When I complained, I got the more recent version of the energy bill that we received back in May, still listing a credit, and an updated rental statement, again charging us for the credit. This time I complained and did not pay the energy fees. I did not hear back from LG Immo Suisse.

At the end of August, we again got an energy bill listing a credit. I complained and LG Immo Suisse removed the energy fees from the rental statement.

At the end of October, we again got an energy bill listing cable charges. When I complained, I was told that I did not have to pay these charges, only the energy charges. When I pointed out that the bill did not actually list any energy charges, LG Immo Suisse again removed the energy fees from the rental statement.

According to our rental contract, the contract would have renewed automatically unless we cancelled it four months before its expiration on December 31. When we informed LG Immo Suisse towards the end of August that we did not wish a renewal, we were told that we could cancel our contract only as of January 31, 2013. This was in violation of our rental contract, which a representative of ASLOCA confirmed to me in a meeting. I notified LG Immo Suisse but they never got back to me about this conflict.

In December 2012, we were notified that the exit inventory of our flat was going to be taken on January 7, 2013. A few days later we got a rental statement charging us for January 1-7, 2013. I notified LG Immo Suisse that a cancellation of the rental contract as of December 31, 2013 rather obviously also implied that we would no longer live in the apartment after December 31.

The exit inventory was taken on January 7, 2013. No problems were found. After not hearing from LG Immo Suisse for several weeks, I complained on February 19 about my outstanding deposit in the amount of two monthly rents. On March 7, I finally got the exit statement and a promise of the return of my deposit within five days. On March 17, I still had not received my deposit. When complaining, I was told that I would get my deposit by the end of March, which did not happen. I decided to get help from a lawyer. I contacted ASLOCA, but they never got back to me despite me being an ASLOCA member. I then contacted Avocates.ch, but they also did not get back to me. Finally, I contacted Sebastien Pedroli with Oberson & Pedroli, who promptly got back to me and mailed a letter to LG Immo Suisse. At the beginning of June 2013, my deposit was finally returned to me.

A final note: In Lausanne, a rental contract by law needs to be accompanied with an official form showing the rent paid by the previous occupant of the apartment. We were not aware of this requirement when signing the contract and did not receive this form with the rental contract.

and you complain six months after here? It's a well-structured complaint but why did you not reach out to others on EF before now?

is this just a negative SEO effort on your behalf? Because if I'd had your experiences, I'd have been on the forum complaining in 2012.

If I had experiences like that, I wouldn't be thinking 'oh I'll go and complain on the englishforum', so the OP probably tried to sort it out in the real world, and now wants to let people know about this company. That's fair enough.

yes but the OP has had no mention of the issues until now (that the deposit is back) and no mention of the year of messing about.

Just a request for a lawyer as ASLOCA were not responsive: Asloca - your experiences

I'd be complaining all the way along as a sanity check and to get other opinions and experiences.

Doubtless there are better landlord but I'm sure there are lots worse....

Hello everyone,

I am also going through hell with LG Immo. It seems that there is now a legal dispute between LG Immo and the new company Arnaud Immo, to which they sold a part of their business. The consequence of that - I am still waiting for my deposit of x3.5 rent to be returned to me even thought the exit inventory was cleared 2.5 months ago. I keep receiving some vague explanations that the accounts are now blocked due to legal process etc but I am wondering - what does does MY deposit actually have to do with corporate affairs of these companies?
Mind you, compenies like LG Immo operate in a "grey zone" as they claim that the standard real estate rental legislation does not directly apply to them as they are in business of sub-letting of furnished apartments.
On a side note, as other people in the forum have experienced, I signed for a studio but then received a 3-bedroom apartment temporary for 2 months as studio was unavailable. The catch was that when I moved in, there were ongoing works in the flat - workers came to replace the window frames and re-paint the floor so the smell in the flat was toxic from the paint.
My advice to you: stay away from LG Immo. Even if you think it is a quick and easy rental service - there is a high chance that it will turn into a long nighmare, in which you will be at their mercy unless you spend a fortune on lawyers.

Deposits can be held on to for up to a year so they still have plenty of time to return it to you and be within the law.

Deposits are automatically liberated after one year if no legal procedure from the lodger is undertaken - that doesn't quite mean the same thing

Hi,

I stayed in one of their apartments and I had the similar behavior. So, in other words, this is the usual practice they have. I have received my deposit 3.5 months later than expected and after I let them know I'm prepared to get legal help.
The bad thing is that the deposit with this company is not the usual Swiss rent deposit in a neutral bank account, but directly in their own account. This makes things difficult. They also have a statement in their contracts that the deposit shall be returned in maximum 3 months if I recall correctly, so any day sooner you'll get it, consider it a personal victory Everybody's experience with them is similar: slow answers, excuses, delays. Make sure you have a legal insurance ready and try to communicate with them on this term, but my advice is not to engage yet in discussions with a lawyer since the specified time for returning the deposit (3 months) has not yet been reached.
