Fit Made Fitness Studios is a hoax!

I am a member since 2011 at Fit Made Fitness studios in Altstetten, Zürich. The gym is OK and the price seemed like a bargaining, but I just want to warn anyone who is a member or considering membership. Please don't!!!


I have repeatedly tried to cancel my membership and they are now sending me threatening letters which borders on black mail. None of which are signed by any co-worker, just with the logo Fit Made AG.


The background is that I have cancelled the subscription in 2013. They informed me that my cancellations was too late (less than 3 months before my membership would have expired). Reluctantly I agreed to pay a full years membership. In August 2014 I cancelled the membership again. This time I was careful and sent it within the specified time limit. The response was that I was 4 days late! They are now claiming me for another years fee. I have really tried to solve this by offering to pay for the four days they claim that my cancellation was late (although it wasn't) or perhaps an extra month or two. They refuse to even discuss.


I have discussed with a lawyer in consumer rights and she is of the opinion that their general terms and conditions is a breach of Swiss consumer rights.


Normally there would be a notice period of one to three months or the membership would expire at the end of the first subscription period. On top of all the complete lack of service mindedness Fit Made has never informed where the cancellation should be sent or who should be notified.


My advise is therefore, please consider basically all other competing gym chains. I have been a member at Active Fitness and Silhouette earlier and have made a thorough comparison. Fit Made with their lack of service mindedness is a disgrace to the Health & Fitness business.

ALWAYS write on your application form / contract "This contract is only valid for 12 months, and will not be renewed" "Dieser Vertrag ist nur für 12 Monate gültig und wird nicht verlängert"

I wrote this on the Fit Made application in Bern. They said it was not acceptable, I walked out. 20 minutes later they phoned me and said there was a change of heart and I could join for 12 months.

Like Sbrinz says. Or put the cancellation on the contract when you sign, and have that manual entry additionally signed by the seller.

Many people believe the terms and conditions of fitness clubs are abusive but you did agree and sign up to them when you joined.
You can try and take them to court for abusive conditions but your chances are pretty slim.
How did you send your cancellation? Registered mail? Do you have any proof that you sent it?
You make not like it (and most people don't), but you'll find that nearly all fitness clubs have similar terms and conditions. It's a little unfair to single this particular one out as being a hoax or scam.

I guess I would argue that if you cancelled in 2013, but that notice was too late to not have to pay for 2014, then your cancellation still 'stands' for 2015, they can't just keep automatically renewing you when you have made it quite clear that you have cancelled and are now just 'waiting out' the notice period...

Have you dealt with them quite clearly and in writing for everything, by registered post ? How much money is this costing you... ?

What swisspea said. Also I would find another lawyer. Have you tried talking to them face-to-face? Sometimes it is effective to talk to the manager in person. It's even more effective when you send a lawyer to do it. You have made it clear you wanted to cancel since 2013 and you've already paid a year's worth of services you didn't want. That being said fitness centers aren't the only establishments playing this game of forcing customers to prolong their subscriptions. When it's about money everything goes unfortunately. I hope you can resolve this issue.

Holmes Place is by far the worst of the worst...have much empathy for your situation !

Why did you wait so late for the 2014 letter? Why did you not cancel the very same day you paid your 2104 fee?

Always use registered letter. Always send way in advance. And if Sbrinz trick does not work and your really, really, super really want to join for just 12 Months: Just send the cancellation letter by registered mail the very same day.

Write "Kündigung auf den XX.YY.ZZZZ, respektive den nächst möglichen vertraglichen Kündigungstermin" / "Cancellation on XX.YY.ZZZZ, or next possible contractual cancellation date respectively".


PS: What swisspea said: A late cancellation is normally valid for the next cancellation date anyway. (At least this is true for housing rental contracts )

Actually that's not true. What companies bet on is that you won't take them to court, due to the cost and time involved.

I have no idea how much it costs sending a registered letter, but after the first rejection I'd probably send 1 per week for the entire year, or 1 per day in the month before the next deadline...

Correct me if I'm wrong but I thought according to Swiss law, a cancellation that is late isn't invalid but rather is only postponed to the next possible date. Hence, your cancellation for 2013 should be valid for 2014. I could be wrong though.

That is my understanding -- and for sure if you worded it as "cancel as of the soonest date possible".

These guys got bought out by BaseFit. So I am not sure how the old FitMade contracts are still valid. If you really want it resolved, talk to a lawyer.
