Digitec - broke my laptop, refund declined!

Hi there
I have a huge problem with Digitec.
Digitec broke my computer, can't repair it and refuse to give it back to me and refound me!
- March/April 2014 I bought a Sony computer there, which started having problems - known problems, usually under guarantee
- 03 January 2015 (!!!) I bring it back to digitec to repair it. And then it starts the whole mess. Summarizing, they BROKE IT. Definitely. They told, it happend during the transport. Looking at the picture I got, I believe they tried to open it the wrong way. However.. after some angry mails from me and incredible slow answers from their side, they admitted they broke it and accepted to repair it.

Now: after long long waiting to get it back repaired, I called Sertronics (their technical service center). They told me, they're "waiting for a missing piece" since more than a month. Luckly for me (irony) this computer is NOT SOLD ANYMORE from Sony! They can't say IF and WHEN this laptop will be effectively repaired. This means to me, that they can't repair it.

Digitec suggested me a change it for another laptop (they say same charachteristics) and refuse to give me back my old computer, even if not repaired.
I got in touch with a lawyer from K/Tipp and he told me, if they can't repair the Computer, they must refound me with the purchase price. They - no wonder - refuse it.

I'm stucked in this situation - and since 3rd January I'm without computer, with no prospect of having it returned in this life!!!!

So:
- never buy at Digitec/Galaxus, they really messed me up!
- any other suggestions? I'm not talking about common sense with timing in repairs, but I mean, they're not respecting even the (swiss) law!

Why did you wait 9 months to bring in the faulty computer for a repair? Sounds like you broke it. I wouldn't refund you either.

Are you kidding? Does it ever happen to you, to get a defect product wiht a defect showing up with time?! What is guarantee for?

However, they sent me a picture with clear physical problems it didn't have when i gave it back!!! I tried to upload the picture here to make it easier to understand.

Sorry I think I didnt't explain it correctly ion the first thread.
The transport I'm talking about is from Digitec -> to the repair center, not from me -> to Digitec, of course. Otherwise I would just accept it

If the law says you can have the money, issue them an invoice for it, together with a letter quoting the relevant part of Swiss law. If/when they don't pay, start debt recovery proceedings (Betreibung).

1. I'm not going anywhere with this lawyer advices - maybe somebody has other advices
2. maybe could help somebody who is wondering if digitec is reliable or not

Yes. My coffee machine broke after a year or so. I got it repaired for free.

I just gave it back to MediaMarkt* and they sorted it all out efficiently.

* In Germany, naturally. Swiss after-sales/warranty service is truly shocking for a developed country in 2015.

As someone has posted - you can start down the debt collection route. However, I wouldn't necessarily advise this at this point because you don't have a signed recognition of debt from them.

You asked a lawyer - they told you the law and your rights. They are in the best position to help you enforce those rights if you are getting nowhere. That is why I asked.. People on here can only provide you with anecdotal advice. How useful that will be to you is well.. impossibly to judge. But forgive me, if I am a little baffled as to why you wouldn't have the lawyer you already consulted resolve the issue for you... It's what we do.. or try to anyway.

My advice: get a lawyer to draft a letter. If you want to write it yourself, refer back to the paragraphs from the law your lawyer quoted. Give digitec a set deadline by which they must respond. Once the deadline has passed then you can either initiate a debt collection procedure or take it to court. You can go to court without a lawyer. Anyone can represent themselves, though it may not always be advisable to do so...

As previously posted on this forum, I too have had shocking service from Digitec, who also refused to refund the purchase price of a defective, unrepairable computer. In fact, it was exactly the same model as the OP's! It wouldn't surprise me if Digitec had sold on my useless heap of junk to the OP. Sony has sold off all of its PC division (or simply stopped manufacturing PCs?), so no, spare parts will not be forthcoming.

In my case, after a very extensive argument with Digitec, I finally gave in and accepted an alternative computer, with the crap Vaio as part-payment -- but Digitec withheld 10% of the purchase price of the Vaio! Utterly unbelievable. The worst customer service I've ever experienced.

I wouldn't go near Digitec now. Buy at MediaMarkt, or Saturn (same thing), or Fust, or anywhere else.

maybe you can get your lawyer to write a nastygram and then if that doesn't work, take them to court.

or make a deal and take a different laptop.

What I find more shocking in my case, is that they broke it!

That's why their terms and conditions ("Geschäftsbedingungen") don't apply anymore. It's not an "unrepairable repair", it's a real new damage they can't get rid of.

Now I'm at least hoping to get my broken laptop back, but they refuse to give it back to me even if it's not repaired (and to properly refund it, of course)!

Did you pay on credit card? Depending on your card provider they may also provide some form of dispute resolution for purchases.
