Re: Day Care Kids Island not returning the deposit

Thanks for your reply. I just want to add that you were looking for an apartment in mid-July of last year, there is a thread on the forum. I do not understand why you would not have just quit in July if you knew that you were moving. The contract is clear of the dates in the quarter when you can cancel the contract and every parent is given 10 days to read, sign and send back the contract. All of this could have been avoided if the terms of the contract were adhered to. It was also your choice to refuse the meeting with the director. I am sure you could have reached an agreement if you met face to face.

Tahnks everyone for answering!
I know that going to the court is not worth it without legal insurance - which I don't have.
I disagree. You can win legal cases without a lawyer as you can represent yourself, make sure you use sound deductive reasoning. It is helpful to present your case clearly with supporting evidence and all documents organized.

Re: Day Care Kids Island not returning the deposit

Thanks for your reply.

In the thread you found I wrote:

We are not in a hurry - ideally we would move mid of the year 2015.
So we actually planned to stay one more year with you and move only before the start of the second Kindergarten year, in a regular term.

But looking for and finding are two different things, you never know how slow or fast it goes. We started to look at the flat we are living in now only in August 2014, and I informed Kids Island that we move next day after we got the contract for the new flat, on 17.08. We moved to the new flat only in December, so surely we couldn't quit the Kindergarten earlier.

If you compare with the flat rental contract, for someone leaving the apartment earlier than the defined term is enough to find any new tenant. Then the old tenant doesn't have to pay future rent and gets the deposit back without any special meetings. It is a standard.

If a similar rule is not working at Kids Island, why was the earlier exit proposed at all?

Looking for an apartment does not necessarily mean an imminent move. Finding a suitable flat can take months so why would they give notice without any clear moving plans?

Edit: post crossed

Why is this relevant?

The customer asked if they could vary the terms of the contract; you specified some conditions and agreed.

The customer met your conditions - and still you refuse to return their deposit.

If you had a problem with what they asked you should simply have said no, although that would be poor customer service. As it is you've managed to turn a simple request for flexibility, initially handled positively, into a PR disaster demonstrating a lack of trustworthiness and fairness from your company.

I completely agree with newtoswitz, and I'm shocked that someone replying in defence of a business would refer to separate unrelated posts made by someone. The initial post was a good idea, but it's never a good idea to get into an argument online.
