Primacall telephone selling

I am just in the process of extracting myself from a telephone contract with Primacall and wonder if anyone else has had the same trouble. they called and called, and i wasnt quite sure if they were swisscom or not. they asked me to confirm i was with swisscom and offered me a 'great deal' but was all done in german and i couldnt quite understand everything so kept on asking them to send the info instead by post so i could consider it. turns out in all of that that i had agreed to a contract with them!!! apparently very easy to do over the phone, and it has now taken hours to work out what happened and how to get out. they were able to switch me from swisscom to them just like that, but i need to cancel this new contract in writing before i can get swisscom to take over again. my german is not sooo bad and so i can imagine that, for instance my lovely old neighbour lady downstairs, might also get equally confused and sign up without realising.

anyone else had the same problem?

When telemarketers call always insist on speaking English - or any other language than German. They normally hang up as they're only allowed to read their spiel in German.

I'm sorry I don't know how you get out of this, but it seems very scammy and like they are using your confused verbal consent to possibly get away with it.

Sounds similar to this story:

Mobilezone Phone 'Scam' - warning

It's a good time to remind folks - If in doubt about anything, just hang up. Never say yes and never say to send you something. Most legitimate contact from your current vendors (insurance, cell phone, etc.) will come in the Post, not via a phone call.

Call Swisscom directly if you're so inclined, but in the future, just do not take these calls. Same thing if you get salespeople at your door, do not answer it. Do not let them in your house, and do not sign anything.

Yes, hindsight is a wonderful thing Now i would rather not even answer the phone. i figure anyone important will leave a message.

and thanks for the number, i have just called and asked for the asterisk by my number. of course, i did this is german... lets hope i did it right

This is what I do; I just repeat "Hello, who is this?" in loud English till they give up. Some are quite persistent and continue their spiel (in French down our way) until I hang up.

I`ve been getting calls lately on my handy, where the person asks me if I speak German and then proceeds to ask if I received a letter in the last 5 weeks (alway starts with that "letter") about an increase in Krankasse premiums.

As soon as I say that is none of their business, they lose interest and hang up.

I did rather use a bit of foul language yesterday as the call came in the middle of hay-making out in the fields in 38c heat and sweat!

If you're pretty sure you've not agreed to anything, ask them to send you a copy of the call. If this is essentially your contract, then they must have a copy.

I find that "F*** off" and then hanging up from my end works even better. Actually not answering the phone is best

Seriously if I'm at home on a weekday I get about 20 calls from telemarketing firms. I've told friends and work collegues to just talk when they hear the answer machine and only then I'll pick up.

I have an old Swiss relative who does not hear very well and keepers saying Ja, Ja when people phone. Consequently she has signed up for all sorts of crap.
They are supposed to send a contract by post that you have a week to cancel.
Usually I can do this for her but if she does not open the envelope or tell me then she is stuck with it.

There should be a law to protect such old people from these vultures.

I didn't check the paragraphs, but I'd assume the seller must be able to prove they sent the contract, including the notice that the buyer is allowed to cancel within x days.

Are non-registered letters (A or B Post) traceable these days?

If not, you (your relative) can simply say she didn't receive the notice, but she wants to exercise her right now, thank you very much. If they send a Betreibung just dispute the claim (sign the forms back side at the Post office when you collect the registered letter), and that's it coz they won't be able to prove their claim (asssuming it's not traceable).
