Fed up with the Police state

Car stopped at the side of the road. Warning triangle displayed. No one in or around the vehicle. Car overtakes said vehicle and crosses single solid white line to do so. Driver stopped by police and taken to court. Fined and suspended from driving for 3 months.

Reader doesn't believe driver. Driver had good chance to see police if police saw him. Police fine driver for crossing solid white line as police were just about to direct traffic. Driver who breaks Swiss driving laws has no excuse. Driver can be described in one word. Idiot.

The Swiss Highway Code (Driving Today) says:
'Continuous lines (Single or double continuous white lines) identify the middle of the carriageway or the limit of the lane.
It is forbidden to drive on them or to cross them.
Only exception: in the case of a standing obstacle that can not be removed instantly'

So something is not right about this story, as an unattended broken down vehicle cannot be moved instantly.

Exactly... so something doesn't add up here. I actually thought you could pass anything going 10kph or less.

You don't actually overtake parked vehicles you pass them.

Anyway without any kind of further info - like how did the police catch this driver and who was he and how fast was he going and was there any oncoming traffic, etc etc this thread is just wasting everyone's time...

Driving Today, item 556 in my version, states:
'Overtaking is permitted at bends in the road and at the brow of a hill when this is possible to (stay to) the right of the continuous line and other vehicles going in the same direction are not hindered.'

and there's a picture of a car overtaking a tractor but not crossing the line.

So there is no exception to crossing a solid line unless as previously stated, the object is stationary and can not be instantly removed.

what speed was said driver going, to get three months he was probably going way too fast, fast enough to qualify for article 16c i guess:

Whatever other details, we probably won't find out, but it's quite obvious that the OP did not, as a first offence, cautiously cross a white line to avoid an obstruction. Yes, there may be a few jobsworth cops around that would try to prosecute for it, but to get a three month ban needs a judge to have looked at all the circumstances, including the driver's historic offences, before reaching such a verdict.

In other words, surprise surprise, the OP is just whinging about getting caught.
