If the contract does not state explicitly that tyres must have a certain depth of tread, I have to say I'd side with BB2.

Anything else is a potential insurance claim because of course you have to have fully comprehensive insurance when you're leasing a car - it'll certainly be a condition of the lease and most likely something they checked when the car was registered.

yep they already claimed on insurance for every single mark on the car, even stuff that wasn't on the handover sheet, it does feel like they are trying to take me for a ride

I think this really depends on how much they value you as a client and how much they stand to make/lose on the car. Years ago when I gave back a beamer, it had completely run down tires and a scratch on one of the doors (bloody concrete columns in parking lots!!). The garagist noted these issues but said that because the car is otherwise in a really good condition, they are happy to cover those issues themselves. I must have really lucked out there.

I don't think my custom matters, literally a week after I leased the car all mini prices here dropped upto 20% so they where always going to lose money on the car

You might want to give the handover sheet to the insurance company. I would be surprised if hey are happy to pay for repairs that weren't listed.

From a contract from a couple of years back:
- the leasee (you) is required to repair (at your cost) any damage above and beyond normal usage
- the leasee is also required to pay for any additional KM
- the car should be returned in a roadworthy condition
- All tyres and wheels included in the contract should be included

Additionally it does mention that if the car had an accident (and registered as such) you would be liable for the difference in value. As well as returning to standard any modifications.

EDIT: More information on tyres from reifendirekt
1.6mm = legal limit
2mm = suggested summer tyre limit
3mm = suggested "wide" summer tyre limit
4mm = suggested winter tyre limit

I have got the bill from BMW now

182.87 per tire (205/45 r17..v)
PLUS
84.72 PER TIRE to fit
plus
14.12 disposal

then loads of cost for replacing both fogs (only 1 was damaged, but should have been done via warranty) and I think 3 hours labour to change the fogs

goes without saying I'm disputing all of this

So a quick summary

-We leased the car
-Handed it back at the end of the lease
-At the handover they marked a couple of small carpark dents (people opened there doors onto the car)
-The foglight was damaged it was a warranty fix that had already been agreed with BMW
-2 months later the garage try to bill me for tires and foglights
-turns out the garage bought the car from the leasing company and have done this work with no agreement from anyone, the leasing company don't care as the garage own the car now, nothing to do with them
-we have checked all the contracts and paperwork we have and no where does it say the tires have to be 3mm (the where 2,5mm when we handed it back)
-we have asked the garage to show us where we agreed to this, now there english isn't good enough to understand my emails.

You really shouldn't stress, you gave back the car in a satisfactory condition, the return was signed by the lease company so the garage can stuff it now.
