Foreign musicians being expelled from Basel!

Due to a change in how the Basel Arbeitsamt applies employment law, world class freelance musicians from outside the EU are about to lose their work permits (and therefore residence permits). Currently there are 55 musicians affected by this change. All these musicians have international careers and most have been living here for several years. Most of the affected musicians are specialists in early music or contemporary music. They help make sure that Basel remains a major center for the arts in Europe.

I'm sure that many of you have profited from the rich cultural life in Basel. Perhaps this impressive cultural climate is one of the reasons you accepted a job offer to come here in the first place?

We have been working with politicians from all political parties to try to find a solution, but now we need your support. Please take a moment to sign this petition, written by a group of politicians in the Basel Grossrat (SVP, SP, SVP, etc).

Isn't if shortsighted on the part of the authorities? These people work and contribute to the economy, don't they?

A) AUthorities by nature are authoritarian
B) authorities often do not work FOR the economy but AGAINST the economy as they distrust Business in general and arts Business in particular

Thank you all for signing! We really appreciate the support. We're aiming for 10,000 signatures - so any help in getting the word out is greatly appreciated.

The musicians in Basel, aside from being of a world-class caliber, are a huge driver of the cultural economy. Although we don't make much money ourselves, we bring people in from outside the country (bringing their Euros with them) who then spend money on restaurants, hotels, parking, etc. The money we earn from concerts outside Switzerland goes toward paying rent here and buying milk at Migros... We are anyway ineligible for social welfare, so I don't get what the impetus was for this change in regulations.

[oh and... when reading about people having a pain with their Bewilligung applications I just have to think: 'at least you don't have to petition parliament for yours...' <sigh>]

Sorry, but I can't see the problem with the rules being applied as they should have been in the first place. And frankly you could see this coming back in February when the vote to curb immigration was narrowly approved. What permits do these people hold anyway? That may make a difference to the fight to stay here.

Still, the Foreign Nationals Act may provide some ammunition for your cause.

"Section 2: Expiry and Revocation of Permits

Art. 61 Expiry of permits

1 A permit expires:
a.on notice of departure abroad;
b.on the grant of a permit in another canton;
c.on the expiry of the term of validity of the permit;
d.on expulsion in terms of Article 68.2
If a foreign national leaves Switzerland without giving notice of departure, a short stay permit expires after three months, and a residence or permanent residence permit after six months. On request, a permanent residence permit may remain valid for a further four years.

Art. 62 Revocation of permits and other rulings

The competent authority may revoke permits, with the exception of the permanent residence permit, and other rulings under this Act if the foreign national:
a.or their representative in the permit procedure makes false statements or conceals material facts;
b.has been given a long custodial sentence or has been made subject to a criminal measure in terms of Article 64 or Article 61 of the Criminal Code1;
c.has seriously or repeatedly violated or represents a threat to public security and order in Switzerland or abroad or represents a threat to internal or external security;
d.fails to fulfil an obligation linked to the decision;e.or a person they must care for is dependent on social assistance.1 SR 311.0

Art. 63 Revocation of the permanent residence permit

1 The permanent residence permit may be revoked only if:
a.the requirements of Article 62 letter a or b are fulfilled;
b.the foreign national has seriously violated or represents a threat to public security and order in Switzerland or abroad or represents a threat to internal or external security;
c.the foreign national or a person they must care for is dependent permanently and to a large extent on social assistance.
2 The permanent residence permit of foreign nationals who have resided in Switzerland in a law-abiding manner for an uninterrupted period of more than 15 years may be revoked only on the grounds set out in paragraph 1 letter b and Article 62 letter b."

A friend plays in the orchestra and is caught up in this. Its not specific for the musicians but a general regulation that non eu must have 75% emoyment. The unique thing for the musicians is that they agree not to claim any sort of social help.

As above try Facebook basel sites. Expats in basel has the largest member base but admin 'dave the dick' may delete it so dont be surprised if it disappears.

It's actually the Swiss you want to reach out to rather than expats - as they probably have more political clout in the end.

I did a "like" on expats in basel and stayed for approximately 5 minutes.

BASEL and MULHOUSE are really worth a visit of a day or a weekend. The two cities also have lots of good museums (for example the Automobile Museum and the Railways Museum in MLH and they BOTH have a zoo. Out of MLH you can visit beautiful vineyards and also make some tastings. Basel and Mulhouse are in fact really nice


What they both in comparison to Zürich, Luzern and Geneva do not have is a decent lake, not even an artificial one like Strassburg-Enzheim. In case you have a bit of time, make visits to Colmar and Strassburg, the jewels of the Elsass/Alsace

Lake? We don' need no steenkin lake! Seriously, the Rhein running through Basel gives at least as much character as the lakes in t'other places.

Sorry, but that's just plain wrong.
  1. The vote in February was not about Non-EU-foreigners but to curb the nearly unrestricted immigration of EU citizens.
  2. Not a single letter of an applicable law has been changed yet due to the result of the vote.
What obviously happened was that some ignorant bureaucrats simply decided to apply the law differently. Everybody who has just the faintest clue of the music business knows that very few musicians are permanently employed at 75% or more.

Yes, this isn't about quotas for EU citizens but for musicians coming from "third state" countries (non-EU or CH). The regulation is that in order to be eligible for a residence permit a citizen of one of these countries must be employed a minimum of 75 percent at a single workplace. Till now this rule has been only loosely applied to musicians but recently the Arbeitsamt decided to revoke the residence permits of fifty-five musicians and to enforce the regulations more strictly.

The requirements for a residence permit are clear; the petition is to change the requirements for musicians. Musicians cobble together teaching and orchestra jobs and performance gigs in order to make a living: almost no one is hired by a single employer at the necessary percentage. Institutions like the Schola Cantorum (school of early music) are so specialized that unless they bring in non-EU students it will be impossible to maintain their current high level of performance and research. The Hochschule fur Musik will also be affected by this. If musicians will not be eligible to work in Basel after their studies then they will not come to Basel for their training.

So the question is if Basel wants to keep its current incredibly high level of concerts and musical research or if the city wants to toss that away. I'm Swiss-American and so want to keep the musicians both for the Swiss and the foreigners' sake. Please sign!
