Tenant / Subletter Rights

Hi there,

I've scoured the forum but unfortunately haven't come up with an answer to my question:

How many months notice does a landlord have to give you if they force you to move out? What are legitimate reasons for them forcing you to move?

If anyone has a bit of familiarity on the topic it would be much appreciated.

Re: Tenant / Subletter Rights

Notice period would be in your contract; should be the same as the notice you need to give if you want to move out.

Re: Tenant / Subletter Rights

They can use any reason they like or no reason at all come to that. If they want you to move and give you official notice (registered letter sent to you by the due date outlined in your contract) then you have to vacate the property.

If you sublet you have to move out too, as your contract is with the tenant, not the landlord/agency. If the tenant is served notice to vacate, you have no right to stay there unless you come to an agreement with the landlord/agency to take over the full lease.

Re: Tenant / Subletter Rights

There are certain reasons which landlords aren't allowed to base their termination of your lease on.

Further info here (no English translation available)

See also in Art. 266/271 and onwards in the Swiss Code of Obligations

Re: Tenant / Subletter Rights

"Legitimate reasons" is a grey area.
The most common reason from large scale landlords is because they want to renovate. As far as I know, there is little to be done against this.
You would have to take advice relating to your particular case.
