Videoed whilst leaving out stuff for my friend to collect!!

Hi a couple of hours ago we left out four bags for my friend to pick up . I put them near where the bins are by the newspaper collection bit is and my daughter told me afterwards that someone had been filming us on their phone . The bags have now been collected , but I'm worried that I may get reported for dumping rubbish.

There's nothing there to suggest we dumped anything now but we have been taped .

What should I do?

I don't want to get a fine , we only put it out there as not valuable and I didn't want to wake everyone up by taking bags out , the doorbell ringing etc etc.

Your neighbour is in the wrong. Her filming of you was disproportionate and possibly illegal.

There are dozens of legitimate reasons you might be putting stuff on the street temporarily.

If she does it again tell her to stop filming you, and if she thinks you are doing anything illegal to call the police.

Hi. This is exactly why you should only dump rubbish in a place where nobody can see you, or at least make sure there is nobody there filming you when you do it!!! Never outside you own house.

Have you read and understood the post you quoted?

They weren't dumping rubbish.

..... and if you're advocating 'fly-tipping', then that is a serious offence.

I'd tend to disagreee. This seems to have happened towards midnight, which makes the assumption of illegal depositing fairly reasonable. Since the filming appears to have been targeted, intended to create proof, it was probably OK at that time.

However, since the bags have been removed it's clear that the assumption was wrong, thus OP can demand for the pictures to be deleted, and certainly no reason for OP to worry.

Personally, I'd talk to the neighbor even if I didn't care about the deleting of the pictures. Explain the situation, perhaps instill a bit of a bad conscience, and try to drag the filmer onto your side - somebody with excessive time on their hands may be a good "watchdog" for your apartment when you're away, e.g. on holidays.

Maybe she saw the bags were gone and took the opportunity to dump 4 bags of rubbish knowing there was a fall guy to take the blame!

I thought the rule is that you should also steal your neighbors' mail, screw it up and dispose of it in your 'illegal' rubbish. Make sure nothing with your address is in there. That way when they search it your neighbors get the fine.

To be fair, how did anyone know you were not dumping rubbish? Near our bins here, the amount of stuff being dumped illegally is rising, and some people are getting really fed up with this- and are beginning to take counter measures, like taking number plates or photos/video to report. Now I wouldn't myself- but I am beginning to understand why people who live near the bins do as they have to put up with this unsightly and smelly illegal dumping - and have to themselves pay for their rubbish to be taken away (we pay by weight here)...

So I am puzzled, why didn't you arrange for your friends to collect stuff from your flat at a time convenient to both. Easier no?

Having lived near a country lane in the UK which was used day in, night out- for all sorts of illegall rubbish dumping in every nook and cranny- be it bags of rubbish, old fridges and tvs, tyres, building rubble, old carpets and even once, waste from the local private clinic with all the patients' notes - I have no sympathy for illegal dumpers of any kind. And I won't even begin to tell you about illegal dumping all over the place in Sicily as we witnessed this year again!

Agreed, it does seem a bit strange. And if the bags contained stuff of some value to the friend, why put those bags near the rubbish area at collection time? Seems a bit unwise and risky.

I hate hearing myself sounding moralistic because I have faults like anyone else, but there is a sense of "I fear the OP doth protest too much". Like you, I may have a particular thing about rubbish collection practices because we have that problem at my block, where stuff is dumped illegally and then sits there for ages until someone takes responsibility for it.

Hi

Talking as a law student and as someone who's father and brother are lawyers. Generally speaking people tend to do too much. Answering letters without thinking, "trying to do the right thing", talking, explaining themselves, often feeling like it is "their turn" to do something just because they got a letter or something. Often the correct way to handle things is to say or do nothing, at least in the beginning. You can remember that for pretty much every legal problem you might encounter in the future.

Filming in a public place generally speaking is never a personality rights violation and therefore never illegal. You can film everybody at every time on the streets for example. Most of the time it's what you do with the things you filmed, where/if you publish them, how well the person can be identified on the video, etc. that might pose a problem. This certainly wasn't illegal.

Someone filmed you, so what. If you hear nothing, there's nothing to do. Step by step. This can be ignored.


P.S.
A classic mistake that you could do that comes to mind right now is asking around in the neighbourhood if it was them who filmed you and then trying to explain yourself. All you would do with that was acknowledge that it was indeed you that was "dumping" something there. Not that that matters really because unless you're talking about it in front of multiple persons, there's no proof of you acknowledging it. Just saying...

All in all this is 100% irrelevant and to be ignored. I wouldn't even think about it for 5 seconds if I were in your situation.

Don't want to get too off-topic, but can this be true?

What if someone sat next to you in a restaurant and started to film you and your partner enjoying a meal out? You ask them to stop and they refuse. Or suppose you see someone (a non-parent) standing outside a school every day, filming the children at play?

These would be highly intimidating situations. I don't know Swiss law intimately but I would have thought there would be some law against such anti-social behaviour. In other words, the act of using your camera in public might be legal by default, but to do so in certain situations requires sensitivity and discretion. Refusing to stop in such situations must be bringing you close to breaking some law?
