Bought a counterfeited bag, probably will get a huge fine

Hi,
my wife bought a counterfeited bag of a famous brand (she thought it was authentic).
Now the Zoll authorities sent a letter to the lawyer representing that company. I have read in internet that they use to send a fine of around 900 CHF as a compensation for the "damage".

I have also read that one can refuse the pay or at least to pay that full amount.

Can you suggest me where to get more info?

In case I need a lawyer I have read there is an online website where one can subscribe for a year and will get the help from a pool of layers or something like that, do you have more info?

What more information do you want? The article is clear on what to do, what you will lose and what not to pay. You will lose what you paid for the bag and the bag itself, but you don't need to pay the 900 CHF.

Is it actually the Zoll authorities or just some company using similar language and naming to try and extort money out of people?

Why would it be proveably illegal to buy a counterfeit bag? I can understand it would be illegal to sell them, but it's surely very easy to deny knowing as a buyer that it was counterfeit.

Also as the buyer what damage have you done the company, so how can they claim any damages? The damage was done by the seller.

There has been lots of discussion around this topic, including on this forum. It's a fake bag. Fake goods aren't allowed and Switzerland takes this seriously. You don't get a criminal record or a fine, you just have the fake bag confiscated.

The zoll authorities send a letter to the lawyer representing the brand and a copy of the letter to you. The lawyer has 10 days to take a decision.

You do not need to pay, send a letter to the Lawyer and tell them that you will not pay.

Also contest the payment with the credit card company - if she thought it was authentic but it isn't then they should also refund you.

Save a copy of the relevant web pages and so on as evidence.

It is also illegal to buy stolen goods - even if you don't know anything about them being stolen. The law may be an ass but it is consistent.

Really? Then why they do not prosecute such online shops rather then the consumers? It is not consistent in this case, but it is easier.

A similar absurd law is in Italy. If you buy say a counterfeited bag from a street vendor and the police sees you, you get a fine. But the fact that there are street vendors everywhere selling around their illegal stuff is somehow accepted, as it is more challenging to prosecute them.

Just go to google, search for luis vuitton online buying bags and skip the first two three pages and you'll fine a few, aliexpress being one of them.

They are reachable over Google and accept card payments supported by the mainstream companies like Visa, American express etc. So why one should think it is illegal?

Ok, a few tips on brand buying:

1) Just because it's searcheable with google, it does not mean it's legal. It applies to shopping, it applies to porn, it applies to news about the world (country dependent).

2) The internet covers the whole world. It might be illegal to sell counterfeited bags in Switzerland, but not in other parts of the world. Use the internet wisely and check the laws of your country of residence before you make a bad decision. It's your responsability as a user to check the local rules.

3) If a bag is much cheaper than the original, it's almost for certain a fake, unless it's so used no one would want to wear it.

4) When you buy a designer bag, make sure you keep the receipt and/or proof of authenticity with the bag at all times. I have been stopped in the airport because of my bag (yes, I confess, I bought a brand bag... I am also made of flesh... ), but as soon as I provided the little card from Prada proving it was real, I was let go with a smile and a "have a nice day". Most big houses will provide these proofs with your purchase to avoid such trouble.

5) Avoid buying big expensive brand items through the internet, unless it's through the official site. Yes, you might be lucky, but if there are people cheating on you in Ricardo on a 50 CHF piece of furniture, a 2000+ CHF bag is not much different...

I can't advise you on how to proceed now that the deed is done, but please be a wise online shopper next time.
