Use it as a pair of headphones? It does have stereo speakers, right?

why don't you also call up apple to get the headphones you did order? maybe your experience with their customer service will help you decided what to do?

also remember serial and manufacturing nbs, that mac is registered.

If you keep something that you know isn't your property - that's theft... but if you've tried to give it back, I'd guess it becomes yours.

Actually no it isn't, I quoted the serial and part no. when I called and there is no record of the machine @apple.

I don't think that'd help, it's obviously a black friday glitch.

My sis who works in Holland for a large Japanese camera manufacturer and has done intl logistics for some time has got in touch with the following points:

1. From a logistics standpoint - there is no record of it being paid for as there is no record of the relevant costs have been paid for with importing it into switzerland legally duties/taxes paid.
2.So, to get it back - they would have to ask you to bring it into an eu country to ship back (where I'd have the risk of exporting it illegally from CH, and illegally re-importing it into EU).
3. or they could write it off..... stock damage
4. It's likely the mix-up will get reported and buried under someones mountain of paperwork and get put into the misplaced stock pile and insurance would pay for it
5. If you ask them - what documents will be needed - how soon can they get them sorted etc - will customs be contacting you....it might be too high a level of effort
6. As I work for an insurance company I have an employment policy obligation to report possible fraud to the Swiss Insurance Association, the Dutch one (shipper) and the Irish one (manufacturer).
7. The shipper will also have a problem with current and future shipments at Xmas time which they don't need if this goes public.

Legally all you have to do is make a reasonable effort to inform them of their mistake after that the ball is in their court.

As stated in the OP, already done since day of delivery. Question is how long reasonably do I wait before it becomes mine....

They often say in the small print that products can vary in specification and may not be as pictured....
