Legal Help Needed - employment related

hi all, Im new to the site. I need some help please..


I arrived in Switzerland a few years ago and

oops not sure what happened there.. any way..

i was given a self employed contract from the uk.. all well and good. as you know its very hard to be truly self employed in Switzerland and in actual fact i wasn't at all. I have now found out that the contract i signed doesn't comply with swiss employment law. as the contract is therefore illegal here does that mean the entire contract is invalid or can they hold the few but remaining terms to account.. needless to say i no longer work for the company but they are holding me to account on a couple of things. i would appreciate some help here

What was the nature of your work? What are the things your ex-employer are holding to you to account? Do you owe them money? Do they owe you money? Do you have a B-permit or a C-permit? In what way did your contract not comply with Swiss law?

Were you advising people, especially expats, on investments, for example?

Welcome to the Forum.

I've corrected the spelling in the title - though the employment related (I guess that's what you meant) isn't really necessary in the Employment Forum.

I agree with the others. Your post is, for us, a bit like someone going to the doctor's and saying - 'I'm not well, can you cure me please?'

It is in fact very easy to become self-employed in Switzerland - I have been for the last 15 years. However, being self-employed with just one 'client' could pose a problem, but not an insurmountable one.

I suspect that the Swiss authorities will want you social contributions paying up (AHV), but we are not mind-readers here. It is impossible to help without any information...

Definitely more information is needed if you with useful help.

One point is however problematic: why on earth have you signed a UK contract while you work in Switzerland?
