Effect of unpaid leave on unemployment insurance

Hello

Apologies if this is somewhere else but I have searched and came up with only a post in 2009 with some not so concrete answers. Im hoping someone has had this experience and can advise. Just finding out this information in german I find quite hard as my german is not great.

I took the normal 14 weeks maternity leave together with an additional 8 months unpaid leave i.e I have taken a year off of maternity leave for which I have a written agreement- I have a suspicion I may be made redundant before I return in the next 2 months - my question is - if I have not earned a salary for the last 8 months would the unemployment paid to me be based on my last salary or on an average - I have worked for the same company for nearly 5 years and have only in the last 8 months been on unpaid leave.. I am just concerned that if I were made redundant that my unemployment would be based on the last 12 months salary and of those 12 months I only worked 3.5 months. I work for a large international and as I understand no unemployment contributions are made when I am on unpaid leave

any advice with experiences would be appreciated.

The salary is usually based on the average of the LAST 12 months EARNINGS. However as you will get 2 months notice minimium. Your pay will be 5.5 months devided by 12.

You are correct if your not working, unemployment insurance contributions are not paid.

Be aware that your rahemnfrist is for 24 months, your unemployment pay is fixed for the 24 months even if you did a 1 year 10K a month job immediately! It's to prevent people milking the system, it would be better to get a 6 months job even on a lower salary before registering as unemployed..........

Be aware you are required by law to accept ANY job paying 70/80% of your insured salary, if that salary is low because of unpaid leave the RAV may find you a crap job & 'kick you out'.

thanks so much.. certainly is a scary situation cause if my salary is 10k then i would only effectively get a salary based on 6.5 (3 months notice) x 10k instead of 120k...
