100% Swiss job plus consulting from US

Hello,

I'm working full time in a financial institution in Zurich. I recently got an offer to work as a consultant for a Bay Area startup in California. I plan to work on this consulting work outside of my regular job time. I don't have a possibility to reduce my full time job to any lower percentage. Also I'm not sure how long the startup consulting could last.

do I need to let my primary employer know about my consulting activities that don't pose any conflict of interest as its a very different industry. I'm afraid that my company might say no to such arrangement as this arrangement might make me more tired and can't focus fully on my primary job. What happens if I say nothing to my primary employer? I think I would need to declare the income I receive from my consulting activities on my tax statement. I'm south Asian married to a Swiss so I don't do tax at source and file independently along with wife's taxes. Is there any way my employer would know about this consulting activity through tax authorities? Would it be illegal not to mention about this consulting arrangement with my primary employer? I'm really in a dilemma and any inputs and insights to my situation would be highly appreciated.

Thanks a bunch in advance
CM

Re: 100% Swiss job plus consulting from US

I think it depends on what your contract says. My contract for example says that I need to seek written permission to perform any kind of other paid work (whether in my field or not). Not doing that can trigger termination.

The conflict of interest is a different issue- in fact, my contract also specifies what type of activities (paid or not) conflict with my job and I am forbidden to perform. Not abiding also can trigger termination, but, in the conflict of interest case, also potential law suits.

I am in the US now, but my Swiss contract (same employer, local office) had very similar clauses. I think it's best to check what your contract says, read up on your company's policy, and perhaps ask HR directly.

Re: 100% Swiss job plus consulting from US

If your performance at the Swiss job doesn't suffer, nobody will find out.
Unless, of course, somebody from the startup just snitches to your current employer.
But that could never happen, right?
;-)

And if you get calls on your mobile from the other job during Swiss work-hours and somebody overhears the contents or if you let it slip to co-workers at some point and reports you to management, they can just fire you, citing lack of trust etc.
But that would never happen, right?
;-)

Most Swiss companies want you 100% (which is often more than 100% anyway).
How much time would that consulting-work take, actually?

Would the US-company be OK with the fact that you're never available in the afternoon?
Or would they just call you in the middle of the night?
