No, but they usually have professional HR people who should know what they are doing and it seems the situation is at quite an advanced stage so i would imagine more than 1 HR person has had a look. I fully agree they could easily be wrong, but this looks quite a serious case and it seems to have reached an advanced stage suggesting the boss maybe involved rather than the HR junior.

We have now contacted the Amt für Wirtschaft und Arbeit and initially explained by email th dilemma. We are sure, he would want more explanation and quite frankly, even to us, it is unbelievable. However, we have kept logs of communications and dates and times. So fingers crossed, a mere involvement from the Amt für Wirtschaft und Arbeit will deter large pharma firm from doing further injustice?? Oh btw, did I mention, same pharma firm's other employees are 'dropping like flies' as in several employees on medical leave due to bad working conditions leading to burn outs???

Oh that pharma company.

HR workers are just like any other. Perhaps in this situation you've got one who knows they've made a blunder but can't see how to back down and are hoping to bluff their way through - because they're 5 seconds away from burnout themselves. Incompetence is always better to assume that malfeasance.

Have you done the above rather than running to AWA or at the very least in addition to it? Sometimes the solution to a problem is very easy.

And employees in Pharma dropping like flies due to burnouts or whatever is hardly news... Sadly enough.
