Employment termination - effective date, signed or verbal?

Hello All,

(I hope this post is somewhat unique or simplifed from others, I did read through a number of others but didnít feel I had a crystal clear answer)

The basics of the situation.
I was called to a meeting with HR and announced they wanted to terminate my work contract.

I was presented with a contract cancellation documents for signing, told to stay at home and that my notice period would be paid out in full.

I refused to sign the document (as I had not read it) and was escorted out of the building.

A letter duly arrived by registered post however it was not available for collection until the first of the following month so I only collected it after the start of the following month.


My question is simply, when is my termination effective? Ė The date of the meeting (verbally informed) or the signed receipt date for the termination letter collected from the post office?

I think it end of that month, in which they have handed you termination letter.

Swiss Authorities Online says:

"C
ontent of the notice letter
If not otherwise specified in the employment contract, the contract can be terminated orally. For evidentiary purposes, however, you should send a notice letter by registered mail."

So, unless your work contract states that the termination must be in writing, the oral termination would be sufficient.

Ok clear, many thanks. I'll check my contract but I guess it's unlikely to state written only.
