Job Advertising and Employment Law in Switzerland

Hi

I would appreciate your advice on whether companies have to legally advertise job vacancies in Switzerland.

My neighbour who is American sent his glowing CV to a large corporation here in Ticino only to be told they had did not have this type of job at their firm and it was unlikely they would consider such a post for the forseeable future.

Three months later he finds the managers wife has been given this position that he was told did not exist and wasnt likely to exist.

He is of course really upset that he did not get a chance to apply as he was not made aware of the vacancy and it went to the bosses wife.

Does anyone know where he stands legally for this and perhaps a case of nepatism ?
Any thoughts appreciated. He wants to sue but he cant afford a lawyer either. So I said I would post on here and see what everyone else thought , thanks

There are no such laws that you are thinking of in Switzerland. The company can hire whom they want for whatever job they want and refuse whom ever they want.

What many companies do is source internally for a suitable person to fill a job vacancy. Looks like that's what happened.

Why doesn't that surprise me from an american?

I think he will find that Switzerland is a totally different culture in that respect. Judges only award "expenses" or "revenue lost" not ridiculous amounts of "damages".

Actually there's nothing to be done about such a situation.

I've went through loads of job advertisement infringements & fraud, which in some cases jobs have been even advertised then given to a relative or a friend, they do have everything pre-planned in some cases.

In your friends case, maybe he gave them an idea about whatever job he applied for & how it could be relevant to them & the boss definitely considered his wife for it.

My advice is to chill & go on with his life, nothing beats the SWISS BEARAUCRACY (That's by law here)

Just to add a bit, It's not like the UK, here there's no "Equal Opportunities" term in the job adverts, actually they do it blatantly to ask for Swiss, EU, Permit A to Z,..etc.
