Cash Bonus When Leaving Employment

So, it's my last working day on Friday. A Swiss friend told me today at lunch that I should demand that my bonus be paid pro rata, anyone have any experience with this?

My bonus relates to company targets as well as individual targets, I can't see how they can pay my bonus, they wont know the company profits until January...........

I think demand = ask. They can estimate the company profits up till this point, but I doubt if they have to.

In my experience this is not possible. You can't really earn or accrue a bonus -- you get it if you're still employed at the date they decide to pay it. That's why there's so many people who plan to quit, but wait until bonus time comes.

I know somebody (no - really not me) who change the job this summer and when he left the company, he got his bonus pro rata already for the first six months of 2010... so yes - it is done and they should be able to come up with something. If you work at a mid- to large employer, the rules should be in the contract.

Your friend must be living in "la la land"

If you voluntarily leave the company, you shouldn't expect any bonus whatsoever, if you're moving into a new company, it maybe possible to negotiate some sort of golden hello, to compensate for move and potential bonus loss caused by leaving your current company.

The company that you are leaving have no obligation to pay you any bonus as all bonuses are discretionary anyway, and they certainly have no incentive in paying you a bonus pro rata, if you do get something for leaving, please let me know where you work!

I'm with scrambled on this one - given the substantial number of people I know who waited for their bonus to be not only declared but also firmly lodged in their account before resigning to go to a new job, I honestly wouldn't be building my hopes up too high on this...

As Trev said, depends on how your contract is written.

And since you have been working there for the most part of this year (and I assume since the beginning of this year), you should be eligible for some bonus.

I guess it's how you define a bonus.

1) Discretionary
2) Based on hitting certain targets or goals

If it's #2 then perhaps you can get it.

If there is some kind of pay-off involved, then my experience is that you get pro-rata based on last year's percentage.

i've also seen this. i was a bit surprised when someone resigned and left after the bonus was declared and paid but still did not receive the bonus because they had already given notice prior to when it was paid (even though after when it was declared). and the bonus is determined by business unit hitting targets, not individual targets/gradings.

as with weejeem, i'd wait until the cash is in the bank before resigning...

Despite bonus being discretionary, some employers will still look at past year's bonus and pay out the something around the average, pro rata.

The argument is that the employee has a reasonable expectation of a bonus if it was paid out every year before this.

However, my company has this year stopped doing this saying that bonus is purely discretionary. Not sure if this practice has been challenged by anyone yet.

Speaking to a friend who used to work here in HR, he confirmed that the company used to pay out pro rata because it was the "right thing to do" (I guess he had no other explanation). He is surprised that this is not done anymore, although he could not think any legal basis how the employee can challenge this.

It is done... I've seen it, and even got it in March at the pro-rata of 3 months.
Usually, it is something you contract when you decide to leave, and it is used to motivate your committment for the last 3 months... once you know you are leaving, so that you ensure that knowledge transfer and current affairs are still done and well performed. Under that clause, it can be decided to release your bonus at pro-rata, with an individual performance rating that is usually "good" (say, 3 on a scale 1 to 5).

Given that you are on the last day, it is late for that dealing, but you may be able to ask nicely "dear boss, so how about the bonus at pro-rata? in most best practices companies, it is considered part of the earning".

Obviously, it is different in regards of any long term incentives, usually not vested and completely forfeited.

Well I think maybe it's worth a try then.

We do not get any overtime etc and are expected to work weekends and evenings, this is then recognised as having 5 free days over Xmas. I questioned them on if I am entitled to this, they said no......which is kind of disappointing as I have worked many weekends for the SAP go live.

Maybe I should send them the bill for the weekend work :-)
