I need an urgent advice. In our Krippe there is a clear owner-manager problem and as we found out this month most of the personal will be gone from January and if they don't find any replacement they will have to close. I have to say that it is unofficial information from manager and personal that they all leave from January and not from the owner or social department. The latest asked Krippe personal to keep silence and don't spread any 'news' to parents until something really happens.

Luckily, I found another place today and will write Kundigung for the current Krippe. The problem is that ideally I would start from March since it is a new group and its good for everyone. Also, I want to take my daughter out of the current Krippe ASAP - I see this nerveousness around and kids do, I'm sure.

By my contract I have to do a 3 months notice and I have 1 month Deposit. So that means I would have to pay twice for March if Krippe is not closed. Question is: taking into account all these unclear moments, do I have I right to quit earlier?

I already see a mess that yonger kids stay with older kids teacher and other way around and sometimes this person doesn't know how to care. Just one episode: my daughter went for a walk without trousers (in only very thin tights) and gloves - it was -3 outside! All dress was at her box. The explanation was: I'm with older kids, I don't know how to care about that small. And she was only Lehrfrau - alone with two kids 2 and 2.5 years.

I'm trying to call social department to ask their advice, but they have lunch. And I have to sign a contract within next 2-3 hours to get this place in the new Krippe.

What happens if I simply don't pay for March and don't go to the old Krippe?

I would think that as a lot of what you are saying is based upon assumption and heresay then you would have to fulfil the obligations of the contract, ie. 3 months notice. Once you have a definitive statement from the current owners this may change, however I would assume tht they have contractual obligations too which would prevent them from closing overnight .

I've moved this over from Complaints Corner to here. Although it has complaints in it - that is not the point of the Thread. It is a legal question and the OP needs advice urgently.

If I could afford it, I'd sign the contract and hope that there would be a method of at least reducing payments to the original place. But you need the money to be able to take the risk.

I just sent Anmeldung for the new Krippe from April and think there should not be a problem to stay for extra month (March) at the new place if I manage not to pay for the old one - they won't take anyone for one month only. It's a new group and it starts from March only. I actually discussed this possibility with the new Krippe. They were not happy about it and told me we would have to make a new contract then and so on, but allowed me to start from April latest, otherwise they take someone else. Trial period starts week before official start at the new place, so my daughter won't stay last week of March at the old Krippe anyway, which is good

Paying for two month is not an option really...

After talking to any side of the conflict and the social department, I found out that they probably won't close the Krippe - some personal was found already and some is interviewed. The owner has a good attitude to us and she allowed us to leave one month earlier without extra charge. At the moment only during phone call but she will send us the written confirmation as well (I hope so). So I'm now waiting for all papers to be signed...

Been there, done that...unfortunately.

We actually were lucky that we'd only been at the day care for a few weeks and hadn't paid thousands and thousands in CHF for deposit yet. When the other parents found out what was going on with the day care, they were like... .

I would still make a Plan B, C, and D regarding your day care. Things can change quicker than you'd imagine with this sort of thing. At least it did with our day care as well as another location owned by the same woman.

When our day care closed, the city sent the parents a letter stating that other day cares in the city had been given a provisional time period (3 months) to take on kids from the defunct day care.
