Acknowledgement of paternity/Child support - please help

Dear all,

I am seeking (legal) information on paternity and child care, I would be grateful if you could advise me and my boyfriend.

My boyfriend has been trapped in a tricky situation. The story in short: in 2007 my boyfriend was involved with an Italian lady living in Switzerland. A few months later this lady claimed to be pregnant with his child and would refuse to have the baby taken away (at the time she has claimed she was on birth control pills...) The DNA material of the baby that she sent to my boyfriend did match with his DNA, confirming that he is indeed the father of the child. This test is not an official (legally supported) test though.

This lady has made a child support claim of 800 euro's a month even though the paternity has not been acknowledged or confirmed by the father. Now it seems that there has been a verdict (not sure from which legal entity/office) confirming that my boyfriend should indeed pay child support of 800 euro's a month. Also, no one knows what this amount has been based on.

Could you please help us out with some information on this?
- Is it correct that the court can issue a unilateral verdict on paternity (the mother has not seen the results of the DNA test yet!) and amount of child support?
- I read that the amount of child support in Switzerland is about 17-18% of the parent's net salary. Is this correct?
- How can my boyfriend fight this amount in Switzerland...in this case we would need an English speaking lawyer...

You'll most likely need professional legal advice - a practitioner who does family law. There is one in this link ( or search using lawyer ) that you might want to investigate further. A public forum is not the best place for legal advice IMHO.

My advice is get a legally accepted DNA test for both child and boyfriend and then a lawyer. I have a child with my swiss girlfriend and we had to go through a whole process (Gemeinsame Elterliche Sorge) which just stated how much I would pay if things went wrong but still didn't give me much input or 'fatherly rights'. In Switzerland this is heavily weighted on the mum and baby, 800euros a month is not alot for a swiss father to have to pay.

It takes two to tango and if the child is truly his then it is his responsibility to pay for his child. 800 EURO per month is not a lot in the grand scheme of things and he really should've thought about that before avoiding paying a few CHF for a little plastic hoodie.

Saying that, if it is his, does he really have no intention of having involvement in his childs life?

Some have strongly held views on abortion. Given this is a catholic country and she is Italian too, it's not surprising.

Do you have any idea how much money it costs to raise a child??? 800 EURO a month barely scratches the surface when you account for medical, clothes, food, childcare for a single parent, etc. etc. etc.

To the OP: May I suggest your partner tunes in to Jeremy Kyle on ITV1 in the mornings...I'm sure he will be able to relate to a lot of the other "hard done by" men
