Swiss Canadian Dual Citizen Divorce

Hello,

I'm enquiring for my grandmother. She is nearly 70 and has been married for 15 years to a Swiss man, she got her swiss citizenship after 10 years in the country. However, as she gets older, she feels more and more like she wants to be back home with her family in Canada. He isn't willing to come with.

What I want to know is, is she entitled to a unilateral divorce, and if so, is she entitled to part of the pension, and what kind of proceedings need to be initiated, given that she is a dual citizen?

Hello Angela,

When you say is intitled to part of the pension are you talking about part of his pension, if she has worked in switzerland over the years she would be entitled to what she contributed, or are you talking about , the pension in Canada and what she would be entitled to there.

As a Swiss-Canadian myself I can tell you that when she is in Switzerland, she must follow the swiss laws and proceedings, and when In Canada (as long as she enters Canada providing her Canadian passport she as to follow the Canadian laws)

The general rule, I've learned is if you enter a country like switzerland for example as a swiss person, then even though you are also Canadian, you need to deal with the Swiss Embassy and not the Canadian one.

It doesn't sound like such a "clear-cut" case. To get the proper answer you are searching for, why not call a divorce lawyer and get the right information the first time instead of causing her more worries by offering possible false information.

Look on www.directories.ch and search for the appropriate title. I am sure someone will be listed for English help.
