UK Tax question over personal allowance

I have been tax resident in CH since 2008 but only recently moved off an expat contract onto a local one, and hence have taken over my own tax affairs again.

Mine is a simple question I hope : I have property income in the UK and filled in a self assessment form.

The assessment came back and I was not given any personal allowance and have been asked to pay tax on the income which is well below the UK personal allowance level.

Now it is quite feasible that as I am taxed here, I am not entitled to the personal allowance.

However given my usual experience with HMRC I wanted to see if anyone was better informed , and identify, if I am entititled , what I might have done wrong on my assessment form.

As a supplementary : my wife who does live here but not work here : is she entitled to a personal allowance ?

Two questions that will help get a correct answer....

(1) is the property income in your name, your wife's name or both?
(2) what is the nationality of the person /people in (1)

You get the allowances then. We are in same situation and have for 10 plus years.

However, you have to claim them, you are not given them automatically. I presume you mean they were denied?

I sent an assessment form in for myself , and it came back with no reference to a personal allowance just a calculation for tax payment and advising me I will be receivng a demand. I rang up as instructed and talked to an advisor ( after a 15 minute wait) who sounded clueless about where Switzerland was, confused by the idea of a a double taxation treaty and I felt I needed to ask for more sound advice . Hence my note.

I think I must have ticked an incorrect box on the assessment form but on comparison with my wife's forms they bear a remarkable similarity.


How do I claim the allowance ? I have composed a letter suggesting I am entitled quoting the HMRC reference from the other contributor to the thread , will this be enough ?

Did you fill in the additional Residence and Remittance pages? It's here you answer the questions to claim the allowance, so my guess is that not. I suggest you write to them advising them you and your spouse are both entitled to PAs and attach duly completed residence and remittance pages that should be available for download from HMRCs website even for prior years.

I can now close this with a happy ending. Wrote letter explaining my error to put an x in the right box. Now tax summary comes back with "nothing to pay" . So thanks to all contributors for help and next year I hope to get it right.
