INTRUM JUSTITIA: how badly can they screw me up

I dont know if this is the right section to post this...let's see

"I was in swiss last year for 1 yr only on an exchange at a university.....I took a phone contract with swiss-com .....paid it for 10 months and then my course got over and I went back home to the US leaving the contract like that.....My idiot mistake "....

Now, I have some cash with me and I wanted to pay the dues.....unaware that there will be a 500 chf fine along with the 2 months due rent....I still am willing to pay the total amount that swiss com have informed me about...however now they said that my account is with "Intrum justitia" and I can contact them ...
As, I read some threads they seem to have a really really pityful reputation globally as harassment parasites......My question to anyone on this forum is :

1. Since I agree to pay the full amount(with fines etc) ,could they being who they are agree for me to pay that in installments as the amount is >1000 chf. They seem to threaten people saying "PAY WITHIN 5 DAYS"

2.I am not a swiss citizen....I dont own any property there ..nor does intrum have my address or anything.....if they don't agree to the installments terms...and I don't pay ...what repercussions can I face internationally other than in switz ? I don't care the swiss repercussions as I am not coming back , I am not even a European union citizen....(lets thinks more north of Europe here)

3. Can this ever effect my immigration/visa process for any other country ? Like could this lead to a criminal case "EVER"

Again a note : I still haven't spoken to instrum ..i am yet to receive a reply for my e-mail from them , which I think will be on Monday...I just want to know what might happen.....as people have faced them before...I am still ready to pay the full amount but I can do so only in 3/4 installments as i still a student....so PLS NO lessons about MORALS ...keep it simple ...If I lagged morals I wouldn't have contacted them after 6 months of leaving the swiss.

Unless the debt is many 1000's, Intrum Justitia won't do anything. Don't worry about it.

It's your decision. If it was me, I would email Swisscom, telling them that you are prepared to pay the amount of the bill (and only the amount of the bill) in instalments, but that you are not prepared to deal with Instrum Justitia. If Swisscom really wants the money, then they will agree to this. If not, well, you tried.

This is not a criminal matter and it won't affect your travel to other countries, and it's hardly going to affect any future visits to CH.

I would just pay Swisscom (without the fines as Jern says) and write to IJ by registered post and tell them that Swisscom have been paid and that you do not owe any money to IJ. If they reply just repeat that you do not owe any money to them.

Thanks for the reply guys......I appreciate it ...
I will wait for Monday and depending on their reply I will mail swisscom..

My debt including fines with swisscom is 950 chf and this includes 700 chf worth of fines itself.

I intend to pay this amount and only this ....As i read IJ would add their fee as well which usually is 200 chf or more...I wouldnt want to pay that...

I was just worried as I do intend to visit countries in the schengen zone and it could resort to some sort of criminal case in my visa background check ...

Remember, legally you only have to pay Swisscom the full debt plus the interest.

Intrum Justitia make their money by bullying people into paying the debt plus their fees. Ignore them!

Thanks for the advice, I wish to pay the full debt to swisscom for sure ....i am waiting till monday to see what Intrum justitia says over their added fees.

Also, could this ever resort to visa rejections to other countries for this becoming a criminal case of some sort if left unpaid (this could only be when they dont agree for payment in installments )

I wish I had known this a few years ago when they screwed me for almost 1000chf on behalf of Inter Discount.

It's legally possible to transfer a claim to a third party. So he probably owes the money to intrum. But he doesn't have to pay the alleged fines which have no legal bases.

Intrum Justitia is a private debt collection service, they cannot issue fines.

If you pay Swisscom the outstanding debt soon (2 months rental + 5% pa interest) then they cannot take out legal debt recovery proceedings against you, and you won't be fined.

Transfer the money soon, don't give Intrum Justitia the possibility of issuing a debt collection notice in the name of Swisscom.

Thanks for the advice...I wish to do say and pay swisscom directly. Hope they agree to it and dont force me to go through Intrum Justitia.

Well in the last 6 months, Intrum haven't contacted me and neither have I received any kid of debt collection notice........I have contcted them only yesterday and am still awaiting a reply.

Exactly. Just to make it clear: you don't have to pay any fines or "admin charges". It doesn't matter what you have told Intrum Justitia, or whatever scary nonsense they have told you. They will try it on with anyone. You're only liable for the amount of the Swisscom bill (plus a few CHF in interest, but I wouldn't worry about that).

okay ...thats very helpful..thanks for letting me know that..

so i have to pay the 2 month rental due +a interest of 5 % pa to swisscom..
Also swisscom is charging me a 700 chf early canellation fee...Do i need to pay this as well ????

An additional 700chf fee for 2 months early cancellation? I would not pay that in your shoes.

Exactly, this is the conflict i am facing as well within my mind....without that it's just 350 chf + interest .....a total of 375 chf ....and I can pay in a single payment itself...

I am not able to judge what to do and i am really scared what intrum ppl will do if I dont pay !!

So it's an early cancellation fee, not quite a fine. I would pay the two months that you should have paid if you had continued with the contract. I can't believe that your contract was 350 a month!

No for 2 months my rental would have been 200 chf + they have asked for some line rental fee or something which is 150 chf....making it a total of 350 chf

how can a "beitriebung" affect a person who is not in switzerland anymore...nor does he intend to come back to swiss?
Can it have any impact beyond swiss in other countries....??

Not unless you are ever asked to provide documentary proof of a clean credit record for the time you where in Switzerland.
