The thing is that with this kind of publicity Porsche will probably settle out of court with a huge settlement. That is how the system works it is legalized blackmail.

Totally agree this is a total waste of everyone's time and Porsches money...
Especially as noted here that the driver's widow already sued and lost claiming almost exactly the same thing (except the daughters lawyers are claiming the car wasn't being driven quickly despite all the evidence to the contrary).
Apparently (and I am not kidding) she has already lost a lawsuit against Con-Edison for putting the concrete pole there...
I guess if you have 80% of the Worlds lawyers then you have to try and keep them employed somehow.
Sad state of affairs that we've come to this.

the court in Cali has already thrown out 4 of the 5 claims made by the driver of the car, the only claim that survives relates to whether or not sale of a high performance automobile in California should be subject to a standard of strict liability (in which case the failure to sell the car with a roll cage could be considered a breach of duty). I suppose there is some very minor risk of a California court assigning strict liability to manufacturers of high performance street cars, but that risk is tiny and almost without question would never survive appeal.

the Walker case is dead on arrival, as it should be. and anyone who would even suggest that a modern Porsche suffers from design defects relating to handling has clearly never driven an air-cooled 911.

Even strict liability typically excludes illegal use - so travelling at double the speed limit in a city would probably count.

This refers to the 911 inherent handling characteristic in that the lack of front-end weight means that not only the does the nose "bob" but under braking you don't get sufficient front axle weight transfer. As most old 911s were second cars, the drivers would panic, slam on the anchors while holding some steering angle, creating a massive pendulum effect and taking you backwards into the tree you were going to hit straight on.

As 911s have become stiffer - and with the help of PASM the cars brake far flatter and have less roll, both of which reduce the impact of the unusual weight transfer behaviour. (Dynamic engine mounts help too). It is also worth remembering that the 911 layout was originally designed to use that pendulum effect to maximise corner exit. In effect carrying some trail braking into the corner and allowing the rear to straighten the exit. With the extra weight over the rear wheels traction is improved and of you go.

Simple
(Assuming you are fully briefed on the the physics)

The Carrera GT on the other hand is mid-engined!

My friend and I went with flowers, and just sat chatting next to my special tree, and I felt at peace. Unfortunately I think it has since been removed to make way for some commercial buildings

This epitomises America exactly.

They will not or cannot accept it was an accident caused by an idiot driving too fast, there has to be somebody else to blame and sue.

It's about time people realised that they have to be responsible for their own actions and sometime the consequences are really not nice.

E. Hollywood? ..... I used to go to an unlicenced after hours Saturday night (Sunday morning) drinking and dancing "club" on Hoover and Melrose, 20-odd years ago (run-down residential property and a few bucks on the door - really laid back place for the 90's).

As we were all bikers (about 5 or 6 of us), we used to pile into the only non-biker's Golf GTI. Many a time I ended up doubled up in the boot ..... glad it wasn't a Carrera GT, though.
