| Help/Advice please, regarding moving out with problem landlord
Our landlord is up to no good again...we've had problems from the beginning, but decided we just needed a flat... baby was "in the oven".
Now, we've found (after less than 2 years) a new flat and we've given notice to our current landlord by phone, letter to be mailed tomorrow.
Here's the problem, by phone she said she would at best let us out with 2 months notice to the end of the month (contract is standard 3 months), but we are moving into the new flat a full month before then...and cannot afford rent on both sides! (Jan 1st vs. Jan 31st next year) We've even offered to pay an extra week, since we are moving over the Christmas holidays.
She insists that she will find the next renter, therefore, not letting us have someone takeover the flat under current conditions. Is this legal? Is there something we can do?
We joined the mieterverband when we moved in, knowing we'd have problems. So far, they've not been too helpful with any of the issues we've had. However, we've sent them an email as well, asking what, if anything can we do legally. No reply yet.
Appreciate any answers that give us a legal footing. Thank you!
