Smoking in Apartment

Hallo,

I am living in 3rd floor apartment. But my neighbour, he always smokinginside his house. This make the corridor smell bad. Do I have a right to complaint? Is it legal to smoke in an apartment?

If the letting agency/landlord states it's ok then there's not much you can do about it unfortunately.

I think you have to check with the contract/landlord/agency, as someone posted, because it may vary. I am not sure about whether there is a sepcific national/cantonal law covering this though.

When I moved in my building, my landlord told me it is allowed in one's own apartment, but forbidden in the common areas - i.e starewells, etc. Luckily we never had this problem because even the smokers among us find it disgusting to smoke indoors, and just use the balcony or go outside!

I find it strange that smokers that have been kicked out of most buildings, are "allowed" to smoke in underground car parks. This was always forbidden by law due to the danger of spilt fuel igniting, and even uniformed security people are seen to be smoking in underground car parking in Bern.

Although not impossible for ignition, there's very little threat from cigarettes on gasoline in this scenario. Too cool and little by means of vapors that would cause the ignition.

To be fair to the OP, there are some new apartment complexes springing up in the Zurich area where smoking is banned in hallways, and outside the apartments in the gardens.

Personally i am finding the documentary on wild flowers, pollination and the creation of habitats for insects, far more interesting..
but maybe I just prefer discussing the birds and the bees, than smoking.
