Termination of rental contract

Hi,
We need to give notice on our rented house, a while back I’m sure I saw an example of a termination of rental contract agreement in German posted here, but for the life of me I can’t find it. I’d be very grateful if someone could point me in the right direction, or post a copy of a termination letter they’ve used.
We are giving the 3 months needed by the contract, so there shouldn’t be any problems, however I’ve been told I have to get the wording right.

it need to be in the language of the canton. then all residence people must sign and date. in addition it needs to be sent certified (it...recomendata) dont know whats its called in german. also send it before the 3 months. as if its one day into the 3 month period it is too late!

Many thanks for your replies. I don't know why I couldn't find the other thread on this subject.

A very simple letter did the trick just stating that we wished to give notice and signed by us both.

I am confused about something. We have to tell our landlord that we leave 4 months beforehand. Fine. But i have been BAKED alive inside my house at 28 degrees and complained to her many times. Several months later, after many complaints, they kinda fixed it and the temperature went down to 24 degrees...great, i stopped sweating and having headaches but then the temp went back up to 26 where it is now. I am tired of complaining and i want to get out of here, however we are tied because of the contract. (been here since september)

Is there any way we can break the contract given that it is just NOT healthy to live here and i am SICK of trying to ask them to fix it? I would move in April

Any advice is greatly appreciated.

Hi Delfinita

I would try going the Schlichtungsbehoerde way...

Find out where the local Schlichtungebehoerde fuer Mietwesen is. Write your landlord and say you want the problem fixed within ten days otherwise you will pay the rent into the court (Schlichtungebehoerde fuer Mietwesen). This tends to focus their minds. They will then either fix the problem or call your bluff. You can also say in your letter that as you have mentioned this issue before and it is a recurring problem you suggest that rather than going to the SB they let you out of your contract a month earlier. Then it is a question of whether they are lazy/reasonable (they will let you leave) or greedy....

If they call your bluff post again or PM me and I will tell you what comes next!

The great thing is that it is free of charge. Are you member of the Mieterverband? That may help also.
