Hi,

I am currently searching for replacement tenant for my apartment in WIL and as usual english forum has been really helpful for getting some good advice, could anyone of you suggest me what would be best option for me based on my situation below.

I am currently living in WIL and planning to move to bigger apartment from July 1 but my current contract is till september 09.

From last week I have started looking for 'Nachmieter' for my apartment who can take over the contract from me and For this I requested my rental agency to send me forms which can be filled by nachmieter.

Fortunately I had started getting good response and last week one lady came to view the apartment and she really liked it but when she sent the form to Rental agency they instead of considering her application for my flat showed her other flats which were available through the rental agency.

When I called them they told me that this was a mistake and they also asked me to provide written 3 months notice that i am searching for nachmieter.

now my questions are
- do we have to provide 3 months notice even if I am searching for nachmieter I have already informed them that i am searching for someone who can take over the contract and they have also sent me necessary forms.

- Can they refer the person to some other apartment available through them whom I search by putting advertisement on local stores. I think this is not professional behaviour but not sure how it works.

- How does the transfer of contract works in this case. would the original contract be on my name and will the rental agency legaly help to get the new tenant and complete these legal formalities like signing contract , doing inventory and checking for necessary demages if any while I vacant the flat.

If they keep on redirecting people to some other advertised flat then I may not be able to find any nachmieter and end up paying rent till September 09.

kindly let me know if someone on this forum have been in such situation or suggest what would be the better options in this case.
