Lanlord troubles with a house

Hello everybody.

I am actually renting a house owned by my ex boss. He wish to kick me out, but as I have the law on my side he cannot though (long story).

But anyway, he recently sent a construction company here without notice, to take some measurement and put some marking in my field, which seems to be in position now for a new big building project.

My question is: It's legal for the landlord to do this, and then start working on the property I am renting, without my agreed nor telling me anything ? For now there's just the wooden markings there, but I'm afraid to see the bulldozers coming soon though.

If you have any idea about how legal this is, or even have some law article I can use against this, please let me know.

THANKS !

Re: Landlord troubles with a house

In short: on the info you supplied, who knows?

You say you can't be kicked out. Why should you not have a notice period like other tenants?

You also say your landlord hasn't told you anything. In that case how do you know your landlord wants you out?

ryanuz...the English didn't get any better second time around....

But the advice to get in touch with the Mieterverband is sound.

Would love to hear the "long story" as to why you think your landlord cannot get you out. Of course he can, it takes time, but it can be done. Landlords often have deeper pockets than tenants.

I know tenants who battled their landlord to win the right to stay. The matter dragged on but in the end they had to move. They only managed to postpone the inevitable giving them time to find another property. They have children in the local schools and wanted to find a suitable property to rent in the same area and this takes time.

A landlord can have cause to ask a tenant to vacate. Situations change, just as they do for a tenant. It is far better to try to come to some agreement.

The sticks you are referring to indicate a buiding project. The owner will have applied for a building permit. Go to the Gemeinde and ask to see the documentation.

The landlord and tenant association can help you but you might first try to find a solution with your ex boss that both of you can live with.

Actually my landlord told me lot of time he want me out, but he don't want to use the law. So, as long as he don't follow the law, he cannot do nothing. On my side, I'm unemployed so I cannot search anywhere else, and need to stay here until I find a new job.

Of course, I don't say I'm untouchable here, and eventually they could kick me out anyway, but for now he don't want to use the law, but just try to intimidate me in other way, so I leave. That's also why I think he started that building construction. To see if that will work to make me go. And that's also why i wanted to know my right about this, and if I had to call the cops when the construction start. Or when random people show up in my property, without me knowing about what's going on.

Thanks for your info though. It helps.

Re: Lanlord troubles with a house

yes, of course, landlord can kick u out if the renter has not paid the rent, but also a warning first, and give 30days time if you have paid until then, unfortunately, still not renter has to go out.

Re: Lanlord troubles with a house

OP should study his rental contract. Did he rent the house and land? Or only the house?

The landlord may have the legal right to build after obtaining the building permit.

They are people from Circus, and usually never make the contract properly. So actually the only rental contract I have, have 2 lines saying I'm renting a house at this address. That's all..
