Don't signing the contract, must I still pay something for the company?

Hello All,

That's my situation: Last week I asked for more information of a erstvermitung appartment that I found on the homegate, the company them send me some papers with the plants and prices of the appartment and the anmeldung, which had nothing wrote about penalties to be paied in case of not sign the contract. As the appartment is not yet ready it was not possible to visit it, so we decide to apply even we were not 100% sure about it, for our surprise in the next day we receive a letter with the contract to be signed and all the conditions. But after visit the building are during the weekend, my wife and me realized that we didn't really want this appartment and that would be better stay where we are now, I wrote a polite email to the company refusing to sign the contract, and got a reply asking us to send back the contract and all the documents they sent to us, and that after that we would receive an invoice from them for their wasted time with us :S

Then my question, am I oblied to send them back those documents? Am I also oblied to pay their wasted time, since we had no singend any document saying that we could need to pay a penalty for not sign the contract? (As I already apply for appartments in the past I know that sometimes it's wrote that you would need to pay 100 CHF, but I never have been asked to pay it when I also refused to sign for other reasons)

It depends - sometimes it is not worth it to contest it or to raise it up with the Mieterverband ( they charge CHF65 for consultation ) if the disputed charge is neglible.
