We purchases an apartment in a block of 6 about a year ago. The neighbours living below us have complained that water is leaking onto their balcony. Since then they have harrassed the Management comany that maintains the building and they organised someone to come and inspect the damage.
After the inspection we were told that the balcony is missing a "seal" under the tiles and thus water is seeping onto the balcony below us. They also stated that we are soley liable for the costs and its not covered under the building (or any other) insurance. This is partly due to the tiles being incorrectly installed.

I have requested from the management company information as to who installed the balcony and when it was done. I do not understand how tiles can be incorrectly installed as they are installed as part of the apartment.
They cannot give me an answer and have no idea who installed them.

They are trying to push me into fixing the balcony and I am actually feeling like I am being bullied into it. Surely some kind of insurance would cover this? and if not how can I be expected to pay for something when noone seems to know anything about the construction?

I have legal insurance. Maybe they can assist?

did you get any kind of survey done on the apartment? if so, and that didn't show up any issues then you may have a claim against them

I called my legal insurance. They advised me that I should personally call the building insurance and they seem confident that I have no liability and that either the gebauedeversicherung or another type of insurance should pay this bill. If the insurance say no then the legal insurance will take over the case. So Im glad I have them.

The funny thing is, having informed the management company of the route that I am taking (l.e that I would like to personally speak to the insurance), they are being very polite.
