Hi all,
in December 2011 I sent the insurance the invoice for the teeth threatment of my child which contained both covered and uncovered items.
The insurance, by (their) mistake, refund me the whole amount in February.
Some days ago they sent me a letter explaining that they discovered the error and claiming the undue part back.
What shall I do? Pay? or is there any way not to do it since it was their mistake and my behaviour has always been fair?

Pay them, assuming all their errors have been corrected.

Please pay them. The mistake or decision to refund or not, is not yours to make, just because you think you have been fair....

If you choose not to pay, they can black list you in some sort of Credit-blacklist in your Gemeinde. It is not worth it, IMHO.

Coincidentally, my tax office credited 2 X 2kchf into my account last month. Today I receive a payment slip explaining THEIR mistake.
So do you also think I should not pay them? I have ALWAYS been fair...

Well that was not the founding argument, I only mentioned that to make clear that I didn't do anything to have them wrong

In fact I was only wondering if some law stating that "once it's paid, cannot be claimed back" would exist here in Switzerland, that's all.
But it seems not to be the case....

turn it round the other way, if they hadn't paid for something you were entitled to and then the mistake was discovered wouldn't you want them to rectify the mistake?

I made a mistake on my tax declaration in 2008, resulting in about Fr 640,-- rebate.

In 2010 they repaid me lots of money!!!

In 2012 the Bern tax people discovered my mistake and asked for the Fr 640,-- to be repaid. I went to see them and pleaded they couldn't back date the claim for so long. Yes, they said we can, up to 3 years late, and so I had to pay it back.

But you don't have to make it easy on them.

Tell them you can only afford to pay in 12 monthly installments.

well if you knew back in February that they made a mistake refunding you the full amount "fair" behaviour would have been to contact them right away and ask if that was a mistake

I guess if you overpay a bill you would be quite glad to get the difference back as well, wouldn't you?
