We aren't in the UK nor in the US.

Here, there is nothing to claim.

And, as it happened in Switzerland and not in Austria, it doesn't matter what Austrian law is either.

Well this ain't the UK.

Also, no one's keeping you from dragging the driver to civil court. For that, you will have to bring up a substantial amount of money for the lawyer you need, obviously prove those lasting damages your daughter's suffering (yes, your daughter, not your loss of earnings or whatever - that is still a different issue) and will probably walk away with nothing but costs. Because well, it's a broken bone and not the loss of a limb.

Again, there are a) criminal vs civil proceedings and b) actual damages vs pain and suffering.


But why do I even bother

the Ombudsman will tell you to bugger off, they handle disputes they are not there to tell you what you are entitled to, do you have a dispute with an insurance company? if so what is the basis of the dispute? what has the insurance co. said?

Yes i know it tom we're in switzerland..anyway i will just wait for the decision of Ombudsman,if the law says the decision is right so all i had to do is respect it it,but if NO then i will do what is the best..

Honey, before you start claiming money and say what you want and why you or your daughter want or deserve it you have simply no case. Step one would be to add your doughter as a plaintiff in the criminal case against the driver. Step two is to list up all the money you have spent or lost due to the accidend.

No "need" for a lawyer. You can do it all yourself up and including federal court. Saves you alot of money. But still a shot load for court costs and fees if you lose, which could be likely w/o a lawyer. (Fees for court depend on how much you claim)

It does take two to have an argument. Tip - there's an ignore function in your control panel, where you can add people you don't want to read.

However, bigblue2's post here is to the point. I and many others cannot understand what you are actually wanting to happen - if you just answered those simple questions, then you might get some very helpful answers. There are even Swiss legal folk on this site who contribute from time to time.

Some of the "hate" you think you are receiving is just people being frustrated at being unable to understand you.
