L permit expires end of November, waiting for the new one...

Hello all.

My current permit is expiring this Monday, November 30 (entry date: December 8, 2008).
Only yesterday did I send the required documents to my employer's immigration partner (Fragomen) because it took HR around two months to finish my contract extension . I suppose their local attorney will apply for my permit extension on Monday and I might not receive it by the end of the year.

During my first year here I had insurance from Helsana, but I sent them the resiliation letter as I plan to get my service from Assura for 2010.
So now I don't know if I can apply for my 2010 health insurance without a valid permit. Do you think I can do it?
Last year, when I received the permit (in late February ) the canton asked me to get a health insurance, which I started paying in April, resulting to four insurance-free months. I'd love to do the same this year, but, given that I am already a resident, can I?


PS. Since I am an EU national I am legally working in the country even without having received the permit.

My concern is not whether I'll avoid paying for it or not, but rather the opposite.
I really need it now (after Christmas actually), and the reason why I stopped my contract with Helsana and decided to go for Assura was the fact that I want to take the 300 francs deductible and also add some extra coverage for hospitalization.
Only last Friday I realised that I might have an issue because of the fact that I don't have a valid permit at the moment and I don't expect to receive by year end...
