non EU pension refund

Hi all,

After long argument with stupid Switzerland authority,
they only gave me 2nd L permit till June 2011.

So I have to take another relocation to UK next year.

Can anyone tell me the name of the pension funds I will be getting back when I leave the country?

and what is the required procedure and forms?

I guess, since I'm not a EU citizen (Korean), I might get it.
How long it takes to actually get this pension refund?
Is any of this correct?

As I checked with AHV department in genava. (022 795 91 11)

It is possible to get AHV contribution back.
Since I'm not EU citizen and there is no social security agreement between switzerland and my country.

The conditions for obtaining a refund of contributions
· You must have contributed for at least one full year
· Yourself and your family (spouse and children under 25) must have left Switzerland or intend to live outside Switzerland
definitively. If children of full age but under 25 remain in Switzerland, contributions may be still reimbursed if the children have
completed their professional education.

Documents to be attached to your demand:
· OASI certificate(s)
· Official confirmation of departure from Switzerland (copy if available)
· Certificate of nationality or copies of valid passports for yourself and your family
· In the case of refugees, a certificate of status is indispensable
· Legalised current certificate of residence abroad or declaration of planned change of residence for yourself and your family

AVS is only the 1st pillar... Depending on what was your salary you may also have 2nd pillar which you must be able to withdraw as you will be leaving the country... I guess the salary limit for 2nd pillar is above CHF 20 880 p.a. for 2011....

Usually deducted 720 CHF per month for AHV,
So I can assume max 720 x 2(employer portion) x 17 ( total months )
= 24,480

but there is a note as following
a. Only employees’ and employers’ actual contributions to the OASI are reimbursed, without interest. Contributions paid by welfare are not reimbursed.

b. DI contributions are not reimbursed.

c. If the reimbursable OASI contributions exceed a certain sum*, the amount is reduced.
Does anyone know
amount of b(DI contribution) or c(certain cap) ?

I could be wrong, but I understood that you must leave the EU/CH in order to get the cash back...

Furthermore I understood that there is a requirement to pay the money back in if you return to CH before a certain period expires...

Do you know any about this?

I'm afraid of telling you are wrong. AHV office told me nationality is the factor.
because they checked whether there is a social security
agreement with one's country.

I called Genava office and AHV office in gemeinde, got the same answer.

Yes it is true, they pay several months later.

Yes I understand that part clearly, but I thought that even if you qualified on nationality, you still had to leave the EU/CH area before you could actually make the claim.....

AHV gave me an answer even I'm heading to UK I'm eligible to get it.
You should not post something you don't know.
If you want to double check, please call 022 795 91 11. They will give a right answer.

I find the entire subject is confusing. Had anyone had good information from (a specific person) at the AVH office in Geneva which they would recommend I speak. Heading back to US.

I came across this brochure recently, which addresses all the questions of social insurance system and foreigners. Seems to me, it doesn't matter where you go, only what nationality you are (unless you're a refugee or a stateless person, who's going to settle in one of the countries with which Switzerland has a social security agreement). The countries listed are Australia, Canada, Chile, Croatia, Ex-Yugoslavia, Israel, Macedonia, Philippines, San Marino, Turkey and USA.

And you have to apply for reimbursement before you leave Switzerland, otherwise it will be much harder to get your money back.
