UBS keep sending letters to me for ex-flatmate

Hi,

For the last two years UBS has been sending letters to my address for my ex-flatmate.

basically the ex-flatmate lived with me for few months between sep-dec 2013. the apartment is in my name. the ex-flatmate gave my name as c/o - correspondence of.

the ex-flatmate now lives in dubai.

i took the letters to a UBS branch on several occasions and told them to stop sending them. they said they will take my name/address off but i still got the letters.

then i threatened them with legal action to no avail. because few days ago i got another letter for ex-flatmate.

question is what do i do now? should i pursue small claims against UBS so they take this seriously?

this is the letter i wrote to UBS:

Dear Sir / Madam,

Let me start by telling you how disappointed I am to even be writing this letter to you.

Two years ago I had a person, xxx, living in my apartment. His UBS bank statements came to my address which is understandable. But he left the country over 18 months ago and has not been living at my address. I have told UBS numerous times to please stop sending his bank statements at my address but I continue to receive them. I even went into your Dietikon branch to request a stoppage. But it looks like you are too incompetent to update your system.

I am telling you one last time. Can you please STOP sending xxxx's bank statements to my address as he does NOT live at this address any longer. If you continue to send the statements I will take legal action.

What "small claims" are you going to claim, exactly? For the mild inconvenience of crossing out the address, writing "no longer at this address" and popping it back in the letter box?

My guess is the C/O bit is the problem. The C/O person is at that address.

The best bet is to get the (ex)flatmate to change the details of the account - I can't see how else you are going to get it to stop.

Several years ago I kept getting letters from an english bank delivered to my home in France.... never heard of this bloke, certainly not someone who'd ever lived at this address. I tried ignoring them, I tried sending them back marked 'not known at this address'. I even asked the postman who said that although he realised the letters weren't addressed to me I was the only english person in the village so he'd reckoned I would know who they were intended for!
Eventually I got fed-up with it and checked out the name in the local telephone book. I discovered that a family with the same name as the one on letters lived three villages away, just possibly a son had moved back from London to live with his parents?
A small part of that address was the same as mine..... just the posh sounding house name part; he wasn't using his street name and house number, nor the name of his village! So not over-urprising that to the person at the sorting office it looked like it was intended for my address.
I finally opened one of the letters, added a very curt note to the sender giving them the correct address, stuck it back into the local postbox..... not had one since!

So; do you have an address in Dubai for this ex-flatmate?
Home or work, doesn't really matter, just somewhere that'll reach him.

Put a "FLATMATE NAME unbekannt verzogen" (flatmate moved to unknown location) sticker/note on your mailbox.
If mail for your flatmate then still is dropped in your mailbox, put a sticker with "FLATMATE NAME unbekannt verzogen, Zurück an Absender, Annahme durch YOUR NAME verweigert" (flatmate moved to unknown location, return to sender, acceptance refused by you) on his letters, cross out your address and drop them in the next yellow POST mailbox without postage.

This way UBS will have to pay the postage of the letter which should be returned to them, and if they try to make you pay because "your address" was on the letter, point them to the sticker and tell them to sort it out.

But hold on - you say they are addressed "C/O" you?

That suggests you gave permission for them to use your name, and passed along the letters? Which means that you actually do have a reponsibility to the bank to deliver the letters, it is definitely not the same as sharing an address.

If you were just sharing, then you could simply tell the post office or the postie, or simply taking the name off the letterbox would be enough.

ps. dk noticed this before me, I just assumed it was Friday abuse and skipped it ;-)

The flatmate should have sorted out his change of address himself. Especially, with bank statements. Is he rich?!! Did his new bank card and PIN number arrive as well?!!

Any mail not for you can just be taken to the nearest postbox and dumped in there! You are not responsible for it even if your name is mentioned in the C/o address! You are not the addressee per se!

I have mail in my mailbox for people who lived here before and for people who don't even exist, all the time. There names are not even on the mailbox!
I just write 'refusiert' on some or 'unbekannt' on others and 'bitte Daten entfernen' on all of them, all of this on the envelope on a blank sticker I put over and covering completely the addressee's name and address. (If you don't do this some mailings come back a second time!)

The original sender has to pay postage plus a special surcharge for this when they receive it! And once they start receiving them back regularly, will soon desist! In my experience most do within a few (3 to 6) months.

This is what the post office told me, - and they said it was the best way to stop unwanted mail to any addressee also (whether on the mailbox or not), so this is what I do. I still have about 5 to 10 letters/mailings a month (down from 5 to 10 a week previously!!), most of it is probably junk mail in any case (it looks like it!), but I have noticed a few official things from time to time!

If your flat mate has moved out of Switzerland and you can prove it, UBS will close the account - no account, no problem

We used to get letters for someone with the same surname. Turned out she lived in the squat at the end of the road so we popped them through the door there.

When I moved I forgot to change my address at UBS - my flatmate returned a letter to UBS. Consequence was my UBS account was instantly frozen. That taught me a lesson

It depends on what is active/open. If the person has more than one account and/or different products and services active, then mail will still come until all of that has been switched to a new address or completely closed down and erased from the bank's database. To do that the bank has to be in contact with the holder of the account(s)/service(s).
