Re: B Permit to end and new job offer

Dear All,

I made call to the Zurich arbeitamt and got a very great reply from them.

'No matter if you have B permit with mit erwerbstatigket or ohne erwerbstatigkeit , if you will leave the current company then your Permit wont be extended and no matter I pay for UI contributions and have a new job offer in my hand, I am supposed to pack my cloths and go back to my country'

What a rude jerks. Then for what we non Europeans are paying UI contributions, Pension contribution to Switzerland if we are supposed to pack our cloths and go back to our country.

Last try I will contact the new company HR to check with Zurich office if she also hears the same thing.

Thank you guys and will keep posting the new information.

Cheers,
Hari

Why? Because they told you what you didn't want to hear?

You can get your pension contributions back.

Don't hold your breath. Your issue us you must have a project based permit. The rules are quite clear. I find it amazing that employers don't always makecsurecthecemployee knows it's a temporary arrangement.

Re: B Permit to end and new job offer

Hi Swiss Bob,

I am not angry on anyone.

I was offered a job in the current company with permanent basis and not for shift basis.

The new company also offered me the job on permanent basis with intensive rollouts.

Thanks and will keep updated.

Regards,
Hari

Dear Hari,
Let me tell you , the labour authorities always hit the panic button very often. So I suggest you take this directly with your new company HR. I hope and pray you get it cleared...

Please do update, because this doesn't make sense at all. If you don't have a project-based, short-term, closed B, which you don't believe you have, you should be able to change jobs/employers/cantons without a problem. I don't get this.

I know you called Bern and they told you to call Arbeitamt in Zurich. But were they able to tell you what flavor B permit you have?

Good luck.

Re: B Permit to end and new job offer

Hi Hari,

If you were Terminated by the company of no fault of yours then you can talk to the authorities about the new offer and i feel it should be considered as OK. SImilarly you should be eligible for RAV. But if you leave the company for better benefits then i think it may be tough with restricted permits.

Keep us updated and all the best.
GoFoIt.

Dear LiquidPaper,

I often find it confusing on how to find the type of B permit that I hold (Project specifi / short term / Closed B etc.,) . Is there a easy way to find it without reaching the labour authorities?

Your advice will be of great favour...and sorry if it was asked in anyother thread..

I think it's very confusing, myself, and I don't know the answer.

My B permit, which I believe is open, says "Mit Erwerbstätigkeit" on the front, and "Selbst. Erwerbstätigkeit is bewilligungpflichtig" on the back, nothing else. But reading all these topics, I'm not sure whether you can differentiate just based on what's written on the permit itself.

Apparently, if you go talk to your HR, they can tell you whether on the form called "Stellenantritt", which they got when you started your job, it is written whether you can change jobs or not. That's all I can say, unfortunately. I wish you luck!

Re: B Permit to end and new job offer

Hi All,

I am writing on behalf of a friend who has a similar. My friend has a B permit linked to his job, which he quit! His B permit expires in March. He is looking for another job here in Switzerland however time is tight. Is there anyway he can get an extension on his current B permit while he looks for a job here or does he have to leave the country? He has a non EU passport, making the issue more difficult.
I hear the being registered on the RAV entitles you to an extension for as long as you are covered by the RAV....is that true?
Any advice, or if you know who I can contact for advice, would be much appreciated.

Many thanks

Re: B Permit to end and new job offer

I switched jobs and cantons back in 2010 with a non-EU B permit. The process was unbelievably simple:

1) Call the Federal Migration office to confirm my non-EU B Permit was open or tied to Employer A (basically, just ask if a Stellenwechsel ohne weitere Bewilligung per the 2008 law is possible under your permit). Your permit status may sometimes not be 100% clear by just looking at the Permit.
1) Accept offer and sign employment contract with Job B
2) Resign from Job A
3) Deregister and move out of Canton A
4) Move and register in Canton B (providing a copy of my new employment contract from Employer B)
5) Start work in Job B
5) Receive new non-EU "open" B permit from Canton B

It took basically 1 week to straighten things, get settled in the new canton and receive the new "renewed" open B Permit from the moment I physically left Job A and Canton A (which was the same day).

Re: B Permit to end and new job offer

Hi Brusch,
Its nice steps and details you provided.

Since how long are you holding B Permit??
And how long did you stayed in Kanton A or Company A?
I think it matters for changing kanton and job..

Thanks for information.

Hi, held a non-EU L permit from 2006 until 2008. I then held a non-EU B open Permit from 2008 until 2010. I got a C permit early 2011. Essentially I worked in company A and lived in Canton A from 2006 till mid 2010. Nothing interrupted the process or clock for the C (being a US citizen, no VINTA needed for the C).
