B Permit and Switching Jobs- Same question

Hi all

Posting similar question though i dont have an answer for my own.
Attached is the work authorization which i got in 2009.
It is a B Permit with 3 years validity.I am a non-EU.
I want to know whether i can change job with this or is this tied to my employer?
I had contacted the Migration office but i got different answers.
can you let me know about this?

It is a project based permit. You cannot normally change employer.

Yes, you can change your job... I am also a non EU. My B permit was also tied to employer and was also a project based one.

But luckily I was able to change my kanton and now I am with my new employer

Hi Swissbob

can you clarify how you understand it to be a project specific permit.

I have currently a open ended contract with the company . Also my permit has the following annotation: "Mit Erwerbstätigkeit" in the front, and in the back: "Selbst Erwerbstätigkeit ist bewilligungspflichtig", which i understand to be authorized to be self employed under certain approval conditions.

Hi vava,

When you changed employer, did the new employer apply for a new permit?

Will my next renewal of permit (4th year) entitle me for an open B ?

Which Migration Office did you contact? Cantonal or Federal? I would ask Federal.

While having a look at your pdf file, your permit does not allow you to automatically switch jobs and cantons without cantonal/federal authorization. Thus, when you switch jobs, your new employer would need to apply for authorization (e.g., a new permit). The open B Permit which is not tied to an employer would allow you to switch automatically without seeking authorization.

In theory you should get an open B Permit in your 4th year, however there is no guarantee.

Thanks for the clarifications.
My 3 year work permit initially issued is valid till June 2012.
When this is renewed , will it be subject to quota?
Though my current permit is Project based as you say, i will be required by my employer after June 2012.My contract with my employer is open.
Can anyone let me know.

After some online research, i found the attached document Stellenwechsel möglich? (Change possible?) which needs to be filled and sent to the "Amt für Wirtschaft und Arbeit". They will reply one of the 3 Options,

1. Change Possible, no need for approval
2. Change Possible, but only with the approval of the current employer
3. Change NOT Possible, Since Project based permit

It takes a week and you will get definitive answer from the Labour office.

New employer name is not needed. I only wrote that i wanted to know the exact restrictions on my permit, thats all.

Can I suggest Moderator to put this info with the form as a sticky? This is the first time I've seen this and believe it might be very useful for lots of people on EF.

It only applies to Zurich. Other Kantons may have such a form but often an email with the same details can get the answer.

Hi, I am in a very similar situation and thus I find it appropriate to put it here.

My B-permit is going to expire on August 31st 2011, I am a PhD student and a research assistant at ETH Zurich. My B-permit was issued about 3 years ago (September 2008), and I had to renew it every year.

My employer at ETH has extended my contract until 1st of September 2012. I will be done with my PhD in about October-November 2011 and will have the option to be employed by my research group until Spetmebr 2012.

I am now planing to extend my B-permit until September 2012. My question is the following: Can I apply now for a B-permit which would not be related to my current employer (ETH Zurich) and will allow me to shift freely to some other job once I am done with my PhD? If yes, how can I apply for this?

Thanks Kkrish! this is just the stuff I was looking for. Filling it up (in German) and shooting it to the AWA asap.

Does anyone know the indicators if the WP is a "Project based permit" or not? from the above 3 options, this appears to be a show stopper ...
