| | | Can I get a B permit if my wife is a student in CH?
Hello,
Next year I am gogint o leave Switzerland, but my wife is going to stay here with our baby and I am planing to commute to CH on a regular basis.
She is a student and thus she will continue having a B-permit.
The question is: Can I get a B-permit based on the fact that my wife and baby are going to live in CH, and we have sufficient funds on our banko account in CH? Let me note that I have a B-permit for 4 years, and the I am non-EU.
Thanks!

If you don't live here for at least 6 months you can't have a residence permit

Hi do you mean in total 6 months? or a continuous period of 6 months?
BUT: One can always take a train to Germany and fly from there if necessary? How can the authorities find out that one is absent for more than 6 months?

What if I am not employed and living in Switzerland with a family reunion visa?
So they will scan my passport when I fly from Germany, but: how is it related to CH? I mean: (1) The German authorities will have no idea that I have a residence permit in CH (2) Even if they know, why should they inform the Swiss authorities about it?

Which considering your wife is a student is highly unlikely. | Quote: | | | | So they will scan my passport when I fly from Germany, but: how is it related to CH? So when you leave Germany after having exceeded your Schengen staying time without a visa they will provide you free of charge (or if they feel so inclined they will even fine you for it) with a stamp in your passport preventing you from reentering Schengen for a period of time.
Buuut on the other hand, if you're so hell-bent on doing it the illegal way... why are you even bothering to ask questions?

Next time, think before providing irrelevant answers.

So I would still be interested to figure out whether the German authorities are supposed to report on my departure from Germany to the Swiss authorities.
My main concern why I am indeed interested to keep on having a living permit in cH is that I would be interested in getting a C permit sometime, and to y knowledge I would be able to do it once I am in CH for at least 5 years. Now it's going to be in September 4 years...

For that matter you could fly to Switzerland, it'd be exactly the same. What matters is the amount of time you spend within Schengen. So if 90 days on / 90 days off is ok for you then you do not need a permit. However if you " commute to CH on a regular basis" then it is not going to work out. So next time think before asking irrelevant questions?

You miss the point, I would like to keep the B permit in order to transmit it into a C permit, one day...

An yes, I can commute to Frankfurt on some basis (once every few months) and then take the train from Frankfurt to Zurich and still keep my B-permit alive by pretending I have not left CH for more than 6 months. | Quote: | | | | | They are not, and they don't care. But you miss the point that if you are not living in CH then you won't have a resident permit. You can't have a resident permit if you are not living in the country.

I will apply for a "family reunion visa" since my wife is a student in Switzerland, and thus will a B-permit. Our savings suffice for living here in CH
for at least 2 years.
