Help!!! Anyone??
I got a B permit. My wife then fiance been deported from Switzerland 2 years ago because of my divorce paper not yet settle so cannot apply visa for her to stay. Now we finally married and cannot live together in switzerland for 2 years now because she was banned from entering europe.
Now, it has pass more than 2 years, and I applied the wife visa for her. Her status is PENDING since 3 months ago when i asked the immigration.
1) pending, does that mean the wife visa is rejected? Or it means that we still have to wait? Since it is we waited for 3 months, will it even been process?
2) Since she has been deported before and will affect the decisions if to grant her the visa, what can i do? I feel so guilty I once made her been deported.

Pending means pending. That is, they have not yet made a decision. They will tell you when they have completed the process. On the 'positive' side, if they were going to reject it, they probably would have done it by now.
It's the christmas season, lots of staff on holidays, busy time of the year. I'd expect that to slow everything down.... it normally does take about 3 months, so I'd guess you'll have an answer soon...

Just that the immigration asked her to go to the embassy of switzerland in our country to report(not stating clearly to us what's that, said the embassy will know what to do) herself, but when she went there, the embassy don't know what's happening. I asked around and a friend here thinks that they want to confirm if she's in her own country. This is making us really frustrated what they want us to do.

It was very helpful for us to contact the consulate general in our home country, and supply our current local contact information, so that when the approval came in, they could easily contact us.
The usual process is that once the permit is approved, the consulate general gets an electronic notification through their internal systems (email) and then writes your wife a letter and sends it to her address in your home country (hopefully it's up to date and she hasn't moved around) - that can take a couple of weeks.
At the same time, you should theoretically get a notification from the immigration authorities on the swiss side.
When was your paperwork actually submitted, fully complete ? The three months waiting period would be from the time that the paperwork was all complete - if there was any delay because of something being incorrect or needing extra details, that would set the clock back a little.
On the other hand, just prior to the permit being approved, we were asked for a lot more documents. So we freaked out. But the permit was approved a couple of days later.
Once permission has been given from Bern, your wife needs to go to the consulate general to fill some additional papers, provide her original passport, marriage certificate and details, and pay a fee, and the entry visa will be placed into her passport.
I'm not sure who you are dealing with at the swiss end, but I would update them by telling them that your wife has presented herself at the consulate general in your home country, but a visa was not yet issued.
There could be a break down of communication, or understanding of the process. They may simply be telling you that 'once the permission is granted' then your wife must go to the consulate general etc, but in this case the consulate general did not yet have the necessary approval.
We found the consulate general in our home country very helpful and a straightforward process.

thanks a lot for the tips, swisspea!! We are just worried sick as she's been deported before and worry it might just affect the procedure of not granting her the visa. Will ask them again what they need us to do.
I've submitted everything in around September.
Permission from bern which means it has been approved? Will the embassy be notified if my wife needs to go there to fill in some forms.. stamps, etc.??
so if the status is still pending means that have not approve yet, then there was a miscommunication between us. Then we just have to wait now. Anything I could do to make the process faster?

Hi
The resident visa for your wife is very much depending on your nationality. If you are national of USA, CA, EU then this will not need long but if you're countries like Bangladesh, Nepal, Pakistan, Sri Lanka etc. then this may take about 1-2 years.

Few days ago, I went the migration office in Bern to personally asked the officer who handle my wife's visa application (as I've receive a letter from them that some info/documents missing). He said a document is missing, he said my wife needs to fill in a form called long stay visa, visa D at the embassy. My wife called the embassy in our home country and explained our situation and she was being told that she's a Malaysian she doesn't need to fill in the form. She just need to get an authorization letter so she can enter switzerland. Then asked her to ask me to call the migration office again for more information.
The problem is, her application status is pending, getting the authorization meaning that her application is approved! But then, it is not. The officer in Bern want her to fill in the form, but the embassy said she doesn't need to.
HELPPPP!!! Please!!! Anyone can figure out what's going on?

So, you received a letter that said some documents are missing ?
Can you tell us what the documents are that are missing ?
This is a two-sided process.
On the 'swiss' side you must complete the paperwork - nothing moves forward until all the paperwork is properly completed.

So, it appears that you have not yet completed the visa process at the swiss end, and there is paperwork missing. They cannot issue you the letter of authorisation until the paperwork is complete.
The steps are very clearly laid out. I'm very curious to know what is missing, and once everything is properly submitted, I am sure it will go smoothly (let's hope you don't have to wait another three months)...

Oh, just noticed that the link about spouse visa is for a spouse of a swiss citizen....I did not find specific instructions for a spouse of a foreigner living in switzerland. In our case the employer submitted the spouse (and three children) applications alongside my husband's application for work permit...
Is your employer helping you to lodge the papers ? Are you on a B or an L permit ? I'm assuming you are a Malaysian citizen, and not an EU citizen ?

I'm pretty sure that's what you need - for the 'D' visa and in section B you tick 'purpose of stay' as 'familiennachzug'.

Good Day,
Please do fill out the following form:- http://www.bfm.admin.ch/content/dam/...sumd-en-de.pdf
along with the required documents stated in :- http://www.eda.admin.ch/etc/medialib...y_template.pdf
and submit them at the Swiss embassy in Malasia.
I did the same for my wife. Only exception was she is US citizen and I am Non-EU and in two weeks the entry visa was approved.
All you have to do is to fill out the form mentioned in this post and submit in Malasia and wait. Incase the authorities require more documents, you will get a letter from the Swiss authorities demanding them. Once you had the remaining documents, you shlould submit them at the local gemeinde. It will be all stated in the letter which you get from the Swiss authorities. Then once everything (documents) are fine, the swiss authorities give the embassy in Malasia the confirmation to issue an entry visa for your wife.
This is how the whole process works. The delay which occurs can be due to the verification process.
