Permit Renewal after 5 years - Is a C permit possible ? Non EU marrying an EU
I have scoured the forum looking for someone in a similar situation, but didn't find any relevant information.
I am non-EU and I will be completing 5 continuous years in Switzerland come this July. As a non-EU, my B permit is coming up for renewal.
My fiance is Dutch and she has been in Switzerland for a little over a year and we plan to get wed in May.
The commune told me today that I will receive an 'EU Letter' ?? after I get wed and when my marriage is legalised in Switzerland.
So my question is, having lived here for 5 years, will we be eligible for a C permit, since I would be wed to an EU national? Or would they then renew my B permit for 5 years rather than the usual 2 years for NON EU?
I live in a small town and with my limited grasp of French, found it hard to explain this to the kind lady at the commune, any insight will be very much appreciated.

From what I have experienced ( and I am no expert) ... in a nutshell, if you have a B permit, basically your partner must have had a C permit for 5yrs+, then only can you apply for a C permit too-after 5 yrs have passed of yr partner having a C status. But best is always to ask your Kanton as some rules are depending on other factors, so ask.
Sorry: Only see now you are not married YET. So not sure how correct my answer is then. But hope someone else will help you. The above was just my experience, in that if yr C status would come from your parnet's C status, she woudl have needed to have her C status for 5 yrs. All rules have criteria attached, so not always so clear. But like said, my answer stems from my own experience on my permit.

Thanks Medster for the link, I'm aware of the 10 year ruling for NON EU, but my question is if I'm married to an EU national, would the 5 year rule apply?

It would -from the point of marriage onwards.

Your permit will change when you get married. Technically the counter would start at zero, and as the above posters said, when you have been married five years you would get a C. However, since you are married to a C permit you will no longer have the Quellensteuer. Stranger things have happened and you could wind up with a C, but technically the law is your time towards C and naturalization is per permit.
