I am from Ghana and married to my Romanian wife in Spain, I have the spanish permit for 5 years but my wife works in switzerland with 'L' permit, I am planning on moving to swiss with her,

Note: My wife have a contract job and she has an apartment on her name already.

1. what permit will I get if I have EU-resident permit already,

2. Do i have to re-register the marriage in switzerland?

3. since my wife have 'L-permit', will I be getting 'L' or B-permit and if I can work with the 'L' or B-permit as well. Also how many years will they give me since i have Spanish EU-resident permit which I think is equivalent to B-5years.

4. How long does it take to get the permit and can i just apply from the gemeinde or i have to go to migrationsamt.

As nobody answers (you're a critical case, but you know that, do you?)
It doesn't matter that you have 5 years permit for Spain, sorry for that.

Apartment = heads of family + 1
if you have no kids, an 3 room flat!, I have 2 kids = 5 room flat!
Contract Job = enough income to sustain you and health insurance without becoming a burden for social security or welfare.

1. Same as your wife, an L-Permit
2. your marriage has to recognized from Romania, bring the this paper as this is an official EU-Paper anyway!
3. As 1, same permit, same duration, you're a "depended" - Work? I think not, but they will tell you!
4. In your case, I would contact the Swiss Embassy in Spain and ask, if you need a family reunion permit? In any case, first "BfM" with the registration of your wife and at last the "Gemeinde", the census office.

In general, with your permit you're free to travel within Schengen and CH.
Come here, visit your wife and go and visit the "BfM" that issued the L-Permit of your wife. They will advise you ultimately and you will get a taste, if they will be easy or if they will make your life difficult.

Sorry, but I'm trying to get my head 'round the situation; your wife is Romanian on a temp L permit... You were married in Spain and you have a 5 year Visa for there ( not that makes ANY difference here in SWITZERLAND, not SWISS, as a non EU country ) and you are wondering if you move here to one of the most un-PC places on God's green earth if you will get an instantaneous B from being married to a Romanian.... well, I'd be afraid to say, on first read, unless you are a diplomat or seriously in demand in a specialist field you have two hopes...bob and none You might get issued an L on the same terms as your wife but certainly no more unless you take over the employment reigns and criteria.

Sorry to be perhaps a little negative in my answer I am by no means an expert in this field like other members such as Shorack Mk2 but people here would definitely need more details to make a more informed response.
