visa EU long sejour kills permit B? (non-EU married to a swiss)

Hi all,

this is my first post here and i hope im not asking something already answered in the forums. I searched but didnt found an aswer to my case:

Im a non-eu national married to a swiss and since 2 years i have a permit B, the previous years i had also a B permit for students.

I got a research position in a lab in france so I will begin to commute between both countries.

but, at the French consulate i was told that as soon as i receive my carte de sejour (residency permit in france) i will have to give back my permit B.

I have a 2 years old baby here in Switzerland and im married to a swiss national. I can't get a job here since i don't speak the lenguage and i got a good research position in france. I know i wont have problems to cross the border with a EU permit but i dont want to loose my permit B since i guess i will have to cancel my insurance and begin again from zero next year when my contract in france expires (its only for one year)

So, since i will be coming and going and my family stays in Switzerland, is there a chance that i dont lose my residency permit in Switzerland?

Am i all to confused by the french representatives at the consulate?

Thanks in advance for any advice.

Maturin Milan

I think the French consulate is making it up. You are not leaving Switzerland so you don't have to give up your permit.

Except if non-EU citizen are required by French legislation to take domicile in France when delivered a work visa. In which case he'd technically have to leave his Swiss domicile and surrender the permit. Of course, as long as the Swiss authorities are kept unaware of the foreign domiciliation, there is no need to surrender the permit.

heyy!!

thanks to everyone for the replies, and to clarify.

I got a student visa since my payment will be a grant (bourse) and not a salary.

So this clarify the situation and put me in the good side according to what you have all said.

thanks a lot for the feedback
