well i am new on this website ...i have some question for swiss permit c .....my wife bring me here in swiss in 2005 and after 1 month we got marry here and and now its already 3 years finished i sent my permit b for renew so this time i will get my 4th time renew permit b but my wife want to apply diverced we are still living together and she is shifting to another kanton end of january i waana know if she waana give diverced and she can give diverced after sepration ? if i will not agree for diverced and she will apply diverced can i get 4th time B permit ? and if she change the kanton and i will stay alone here so the can stop my b permit 4th time ? please reply me i will wait for ur anser

Not sure what your post has to do with permit C but if you are no longer married then you are no longer a dependant of your wife and will lose your right to that permit - the authorities are particularly tough on your type of situation for obvious reasons however unfair this may be in any given relationship.

And while refusing divorce may be a way to get your 4th B permit, you'll never make it long enough to get a C (5 years) because after a certain time of your refusing the court will simply grant the divorce to your wife - whether you want it or not.

Any chance of asking your wife to postpone the divorce proceedings until you get your C permit? She would have to wait 2+ years. Asking someone to wait 2 years for a marriage that lasted only 3 years would be a tough ask though. She is the only one who can save you my friend.

What happens if the thread author finds a new girl to marry? Would they still kick him out as the new marriage would be classed "marriage of convenience"?

Again, however unfairly, this would be looked on with suspicion.

But there is another way - if the OP gets a job while his B is current that could provide a solution?

I think the permit gets renewed automatically if you are married. Not sure but I do not think they even check so it renews every year automatically without any signature needed. This is unlike a job-based permit wherein the company has to sign the form.

So I think you might get it without any problem anyway, both the new B and the C.

From the op you can see that the permit must be renewed annually. The C permit involves a seperate application.

This is unlikley given the circumstances.

If he gets a job, he can apply for a B permit that would be dependent on his newly found job.

But this will undergo the same requirements as any other application for a work B. So there is a high chance it would get refused.

For what he explains and as long as the experiences I have seen during the last 12 years, She'll divorce him and the authorities will ask him to leave. Any new marriage or newfound job or studies will be seen with suspiction. However there is a chance he could stay. I think it is small.

Not exactly - since he can access the job market without restriction nor quota on the back of his current B permit (we don't know - maybe the OP already has a job?!). Once the divorce is official, the type B permit will merely change.

I understand the permit has to be renewed annually even when married but i think you just have to send it in. And the new one comes back.

C permit is a separate application but if married, should go through most of the time without too many questions asked.

It is the job-based permits which involve signing of the form every year by the employer.

thanx for ur advice ....u know what we still together and she cant apply diverce till we go for seprate and end of this month she want me to resign of house agreement and if i will resign house agreement then we can still stay together next 4 month till end of May then in june she can apply diverce and then i will not agree for diverce that called one sided diverce .normal what i heard that diverce can take 2 years timing if one person don agree for diverce .in 13 january 2010 i will finished my 5 years in swiss and diverce will happen in june 2010 and before diverce i will get permit c. i have plus point for me that i worked here in swiss and i can move my bills myself i am not depend on my wife .what do you think is i am rite ?

Not automatically, at least not for me, a citizen of a third-world country. My husband is Swiss and we've been married for a little over 3 years. Each year, we/I receive a letter and a form from the Gemeinde people about 3 months before my B permit expires. I have to fill it out (asks about residence and so on, pretty straightforward stuff) and sign it and take it over to the Gemeindehaus to turn it in with my current permit. Yep, I'm without one for as long as it takes to get the new one back . Anyway, the new one arrives a few weeks later, I receive a notice in the mail from the Gemeinde and I have to go (in person) to pay the fee and pick up the permit.

So the divorce filing would start June 2008 and you would be in a "holding" period in separate residences for 2 years because of this one-sided divorce thing you're talking about. Under these circumstances, it seems to me that the authorities would have no obligation to count the time until 2010 towards facilitated naturalization based on marriage to a Swiss.

No, I don't think your are right. On what basis would you not allow the divorce? The authorities will possibly see this as a bad thing.

Are you in employment at the moment. I believe this would put you in a better position than trying to hang on for time served as you describe. If you are currently working on a permanent contract then, with a little help from your employer, you may be able to change the type of your permit to a standard B.
